Applying for Student permit from US while spouse (working in US on H1) has a PR

Hi guys,

My husband (on H1B) and I (on H4 visa) are staying in the US currently. My husband already has a Canadian PR and his transfer process to Canada has been approved. However, the actual work will take at least a month. Meanwhile, I have secured an admit for Masters from a Canadian University. What are my chances of getting a student permit if we apply as dual intention visa and disclose that we will be applying for my PR in the future? What is the processing time for obtaining student permit?

I am in the same situation as yours, with my wife wanting to get a student permit. I already have a PR and am looking to get her an admit for Masters.
I am on H1B and my wife would be getting a H4 soon. Hopefully, someone can answer this.

@SnehaP30 , I think we should connect. Please send me a personal message to connect.

Does your wife have an admission letter? If so she can apply for study permit.

You could be eligible to sponsor her PR

This could be advantageous since you could potentially get the much cheaper Canadian tuition rates

Thanks @shannon388 ! She doesn't have the admission letter yet. Let's say she gets the admission letter, is it possible to get the Study Permit given I am already a permanent resident? Will my presence cause any trouble for her? Like the intent to stay/return in Cananda.

Right now, the spousal sponsorship is taking too long (I heard more than 6 months in many cases, and even 18+ months in some cases). I don't want to be away from my wife that long. She is interested in doing her masters anyway. So I thought I would get her the Study permit and then when she is there, I will work on her PR sponsorship.

Your case is a bit delicate. Any officer could doubt her intentions to leave Canada.

>Let's say she gets the admission letter, is it possible to get the Study Permit given I am already a permanent resident?
yes

>Will my presence cause any trouble for her? Like the intent to stay/return in Cananda.
possible, the officer has some discretion here...

Before she gets the study permit, she could also try to come as visitor (normally 6 months, extendable) - again you being PR might work against her in this case...

Do you know how long it is taking these days to get the Spousal Sponsorhip approved and completed (i.e. wife to get PR), given the documents are collected in approximately a month?

How long does it take to get the Study Permit given the admission letter and other documents are ready?
