Thanks for your feedback. currently I am still waiting for my LMIA, I am still out of status and still staying here in canada. I have til dec 18 to restate my status. I have another situation going on. While im waiting for my LMIA result i got another invitation for PR under skilled trade after I have been refused the first time. My question is can I submit my PR application now even I dont have a status here in canada? Does it affect my PR application because right now I dont have a status no LMIA/work
permit. Thank you

When you file your PR application as an inland applicant you will have to declare your status in Canada. If you are out of status, but still within the statutory time frame within which you can reinstate your status or change your status, you can explain it in LoE when you submit your PR eAPR.

Hello All, Need your guidance.
I received PPR on Nov 08 . I am the primary applicant and my country of residence is India and my spouse country of residence is USA.

I received a mail on my personal email asking me to submit our passports to New Delhi Canada high commission. I emailed CIC asking them to change my spouse VO to USA and leave mine as New Delhi.
Today I got a message on my CIC account(not personal mail) asking me to submit both of our passports to NY Visa center.

Now I am confused on what to do. Should I proceed and submit my passport in India ans should I ask my spouse to submit his passport in NY. Or should I mail NY and New Delhi VO's reg this issue?
Now I have 2 letters , one asking me to submit both of our passports to NY and another asking me to submit both of our passports to New Delhi.
Thanks
You need to send another CSE and email to CPC Ottawa and explain it properly, this usually happens when your letter or email is not clear. Just clarify that you you want to submit the Primary applicant's passport in New Delhi and the spouse in NY.

How long does it take to get ppr once we are in IP2? And what happens to our application on IP2?
The IP1 or 2 does not matter. What matters is whether you have cleared eligibility. All application go through the following stages:
R10
Medicals
Criminality
Eligibility
Security.

To read more see https://www.getgcms.com/blog/express-entry-application-processed/

The IP 1 or 2 does not necessarily correspond to any of the stages. Only after your eligibility is cleared, that your application os 90% through and is only pending security. Security is a complicated process and may take anywhere from 3 week to 2 years or longer.

See what your GCMS notes say.

Hello legalfalcon,

First, I appreciate your time in replying to all the questions in this thread.

I am a temporary worker in Quebec and my work permit expires in OCT 2018. I recently applied for CSQ, but Quebec has stopped processing CSQ from March 2017. I will not be getting my PR in time before my work permit expires.

I also want to move from Quebec because my wife cannot find a job due to strict French language requirements.
I am thinking to apply for Express Entry.

Will CIC reject my EE application because I already applied for CSQ ?
Just because you applied for CSQ will not result in rejection, but you will have to show your intent to settle outside Quebec if you are going the FSW route.

See this case for details and clarification -

Apologies for not making the query clear. I hope following makes it clear.

I do not meet 6 months average balance requirement (it's been only one month that I have gathered required amount from my salaries). As advised by you above, I'll have to show the source of the funds through my payslips.
The actual question is: It's mentioned on my payslips that "This is a computer generated document. No signature is required."
The payslips are on company letterhead. Are these payslips acceptable as the source of fund without signature and stamp ?

Side note: It's my current company and I'll be providing it's experience letter (signed and stamped on company letterhead ) as a part of my work experience.
Many thanks.

Yes, the payslips are acceptable.
When you have to declare your PoF, IRCC only is concerned about the fact that the funds actually belong to you, and are not borrowed. Also the funds should be in your possession. One of the way's of doing it is by showing the 6 months average balance, as you will only keep your funds for a period of 6 months. If you do not meet the 6 months average balance, you can show the funds through a gift deed, or through the source.

Hello Legalfalcon,

Can you please help me with my below query?

I have received PPR and want to submit mine and my spouse’s passport. However we both live in different countries. I have been asked to submit both the passports at Vienna office but its not possible to submit my spouse’s passport at Vienna as she lives in a different country.

Can you please suggest what should I do?

Thanks for your help

Send an email if you have the email for your VO or raise a CSE and explain the situation and request the visa office you want to submit your spouse's passport to the different Vo.

Make sure that your request is clear and not ambiguous.

It will take 3-4 weeks after you make a request, but it will be granted and new set of instructions will be given.

Thanks legalfalcon for your advice.

As usual I am given a period of 30 days to submit the passports.

However my spouse is expected to travel to my country during 3rd week of December.

Can I ask for an extension for submitting our passports so that we both can submit our passports together to Vienna?

Is there a possibility that they will grant me an extension for submitting our passports?

Thanks

Hi legalfalcon,

Could you please tell us which type of affidavit to use for POF? (Affidavit for POF prepared in US)

We saw different types of affidavit formats in USLegal website like General, Financial, Consent etc..

Thanking you in advance

You don't have to do either.

Showing funds held in joint accounts and spouse’s accounts
If an applicant’s spouse is accompanying, the applicant can show the funds held together in a joint account to meet the PoF requirement. However, to be able to show the funds for meeting the PoF requirement, held in an account under the spouse’s name only, the applicant must prove that they have access to the funds. This can me done by the spouse executing an affidavit affirming that the funds held in the spouse’s account can be used by the applicant for the purpose of meeting the PoF requirements.

Similarly, if an applicant has a joint account with their parent, then the parent will have to execute an affidavit affirming that the funds held in the joint account can be used by the applicant for the purpose of meeting the PoF requirements.

@legalfalcon

Once I landed as a permenet immigrant then Can I go to India without waiting for my PR card and return to Canada on my current TRV & PGWP which is still valid?
Or I Just wait for someone to send my PR card back home once it's arrived here in Canada?
Or I applied for Permanent Resident Travel document once I reached India for a comeback ( I don't know how long it will take and if I used that then do I have to apply again for PR card once I come back?)

Which is the best option according to you if traveling is unavoidable?

Thank you for your help.

Hi @legalfalcon !
I have a question for you regarding passport stamps.I'm setting up my travel history and I have a stamp that has a wrong date (1 month difference from what it should be). It has been over 5 years since that stamp was set. I have other stamps (lay overs) that confirm the dates of that particular trip. The visa/country that corresponds to that stamp with the wrong date gives me six months max stay at a time, they usually put the 6 months date stamp along with the port of entry stamp in all the other stamps from that same country. Therefore, currently my date stamp is i.e. feb 23, xxxx with validity until sept 23, xxxx when it should be march 23, xxxx for a total of 6 months max stay.
My question is, would it be enough to explain this in the letter of explanation?

Hi @legalfalcon , Just reach Canada. Raising CSE for address change for my FSW application. Right now I am at NA2 stage

I am using this link:
https://secure.cic.gc.ca/enquiries-renseignements/canada-case-cas-eng.aspx

The instructions in the PR application submission states: upload all the relevant documents to support your change in circumstance.

So do I need to attach any additional documents to justify this change of address? may be scan stamp of Pakistan exit?

thank you in advance

It does not matter what you did and how long it took you to do it. What matters is what your ECA report says and you get points for that.

When you fill your personal history, use the exact dates of when you were studying, irrespective of whether your degree is assessed as 4 years or something else.
I cant remember the start date of both my courses, but I have put the end date as the certificate date. What shall I do for the start date?

@legalfalcon I have my gcms notes with me. According to them my eligibility is passed (notes at the bottom written as a paragraph by the agent). No sign of security screening since 2.5 months of AOR. My file is moved to LVO on 20th Sep and my notes were generated on 5th Oct. I am just curious to know the possibility if LVO can initiate the SS as well or it can only be done at CIO Sydney or Ottawa? Thanks!

No need to worry about it. When you land, inform the CBSA officer and he will make the correction in the record.
Followup to previous question on COR IN COPR..When I update the CBSA officer regarding th COR would they consider it an issue ? Is it like different officers would react diff?
How does COR affect PR Card application?
Will it be some misrep if I dont update ?
