Thanks a ton for your replies and suggestions team :)

As my application was still pending when the changes were made in march 2016, would i now be able to request for the reconsideration of this same file, by sending a reply to this mail, asking to reconsider my file under the cec stream ? or do I have to apply whole together with a new and fresh application from starting??


And is it a sure thing that if we change the available funds to zero, and apply a fresh application, I will be sent an invitation under cec stream??

Just want to confirm once again.

And I have another question. How much time do we normally have before or in which we can request for a reconsideration with cic after a pr application has been refused??? I mean, what number of days we can't exceed at maximum?

You don't need to put funds as zero. I replied on last page. In March 2016 changes were made, if you're eligible for both FSW and CEC then you'll be invited under CEC

It is best to ask an expert about this. Do you lose anything by appealing the decision? On what basis do you form your appeal? Are you even eligible to appeal? And if you have this negative decision on your file, can a future application be compromised? You need to get answers to these questions.

It should be within 15 days. Start counting, when they sent refusal.

I'm experiencing the same issue.

You are right. But before the changes were made in March 2016, folks were doing this to make sure that they get invited under CEC

A question I have asked myself many times about this "amazing" immigration policies - unfortunately NO. Without LMIA or being invited under CEC, FSW inland = FSW outland

Once we request for reconsideration through the web form, how many days would cic take to reply and let us know, if they are going to accept and review my file by reopening it or declining the request??? And if they reopen the file (hoping for it) , the how many days they take to make a decision ??

They replied within 2 weeks. But since they upheld the denial I dont know how long it would have taken for them to review and approve

I doubt they'll reconsider. You accepted the FSW invite. Its on us as applicants to know the rules and ensure we meet the criteria when we apply. Them changing the rules after you were invited doesn't change the fact that you accepted an invite that you didn't meet the criteria for. And still don't meet the criteria for. You were correctly refused.
even if they did reconsider, I believe it takes far longer to re-open a case than it would simply to just re-enter the pool and wait for another invite.

Thanks for your reply Purplesnow. Yes Even I doubt that they may reconsider it, but whats wrong in giving it a try. I have consulted couple of lawyers and they said that they have requested same thing for some cases before and they got a positive reply. Meanwhile, I am even working on entering into pool again and submitting a new application.

hi all

I read in another thread that the offer letter should clearly say that the work is "permanent and not seasonal" (for LMIA wp)

I would like confirm if this is true?

my letter states "permanent" but does not indicate "not seasonal".
I am hoping this is sufficient, but I got some doubts reading those multiple rejections due to not using some key words.

Hi Fateh. What kind of issue are you experiencing Fateh?? Is it same as this? Conflict of to in which class should a candidate be considered if he/she is meeting requirements of any two or more classes? Is it the same kind of decision you got?? If yes, please keep me updated about whats going on next.
