Need advice: H&C application + Family Violence TRP situation (Canada)

Hi everyone, I’m looking for advice and information from anyone who has experience with H&C applications, Family Violence TRPs, or similar situations.

I came to Canada in 2009 as an international student. My study permit expired in 2014. I married my husband in 2014, and we have 4 children together. All of my children are Canadian citizens and are under 10 years old.

My husband never applied for family sponsorship for me. I have built my entire life in Canada over the past 15+ years. My children were born and raised here. They go to school here, have friends here, and their family connections are here.

Recently, I separated from my husband due to domestic violence. There is currently a no-contact order in place. I am in the process of applying for a Family Violence TRP and an H&C application.

Right now, I have no income. I cannot work because I do not have authorization, and I have not been able to access financial assistance or CCB.

My children are with me full-time, and I have been their primary caregiver since they were born. I have been doing everything I can to maintain stability for them, including supporting their education during a very difficult transition.

I am hoping to hear from anyone who has been through something similar:

1. How long did your H&C application take?
2. How long did a Family Violence TRP take?
3. While waiting for H&C/TRP, what options are available for someone in my situation?
4. Is there any possibility of accessing work authorization, Ontario assistance, or CCB while these applications are pending?

How have you had 4 children in Ontario without OHIP? Do you have a financial support order from the courts on top of the restraining order? Is the restraining order for the kids as well or do you have a custody order? Assume you have documentation of the domestic abuse through things like police reports, pictures, etc. Are you in a shelter or how are you affording to live in a home?

The restraining order includes my children, as they are also involved. They are currently in my custody.

I have been staying with a friend because I have no income and have been unable to apply for housing or rent a place of my own.

I feel completely stuck right now and don't know how to move forward.

Apply for TRP and you will get a work permit.

Eventually there's a path for PR as well.

1. Nobody can tell but use FV – In Canada – Humanitarian and compassionate considerations
2. Usually very quick.
3. None, but you can have a survival job, nobody will punish you for that.

You should be pursuing child and spousal support. Until you file taxes you are unlikely to qualify for CCB and you will have to ensure your spouse is no longer claiming it.

We have never applied for the Canada Child Benefit (CCB). Neither of us has ever applied for or received it.
