I will take a volunteer departure and go back to my country and apply from there. There are 50-50 chances from staying here in USA and apply.
Yes that is very true, because you must be admitted in American legally and maintained status before you can apply.

My husband and I had our work permits approved while we were in the U.S. We flew in March and have been in Canada for a few weeks now.

So were you on pending asylum in USA ?? And if yes can you please guide me what did you mention in letter
Of explanation.

I also in a same situation. I received a BC PNP and apply working permit from the US. I consulted with 2 different attorneys. Both told me it may raise concern due if your PR or work visa expired you cannot return to either US or your origin country. But one attorney told me to attach my US EAD card, one told me not to disclose until problem arises. What’s your experience like? Thank you

I decided to take volunteer
Departure and go back to my home country to apply my Canadian visa from there. I also consulted with top level immigration consultants they all told me to do this. Because we have to disclose what status we are on in USA. When you gonna fill out the form for work permit there will be a question asking if you have ever applied asylum in any country if yes then what so this will raise a question eventually. Honestly i was very confused and got no definite answers from anyone so I decided to go back. I want to live somewhere where I can get legal paperwork done for my future. I wouldn’t suggest you to take risk. But you can definitely process your file for PR from USA but don’t apply for just work permit. You can definitely get the PR from Express Entery.

Thank you so much for your reply! And best of luck for your immigration process. I rushly filled my application and now it’s under process. I just have concern how to pass Canadian border. I probably will have to go back to my home country then fly to Canada to abandon my Asylum case so Canadian Border patrol will grant me access. I am completing paperwork for my Express Entry invitation, the application doesn’t even ask for my current immigration status in the USA.

Thankyou for wishing and I wish you the same and I hope everything goes well. Can you please tell me if you have applied for Work permit or just PR file directly and When it approved please update me that as well so I can have some relief

I received my Invitation to Apply, and kow just waiting for employment referral ( thebpaperwork from my current job that stated my wage, length of service, duties) and ECA from WES ( I ordered wrong evaluation). Surprisingly, when I filled my application for Permanent Resident Express Entry, they didn’t asked my current status in the US. Although for my bridging work permit, they asked me current status in the US and I was being transparent and put “pending asylum”

Ohh i see, am happy for you brother. Yeah the PR process is big different from work permit process I believe. But yes you would definitely be able to go. I have one suggestion for you dont abandon your asylum from US and go to you home country just ask your attorney to apply for volunteer departure for you once you get your PR amd then book a flight for Canada directly or go to your home country and then go to Canada. Dont leave without volunteer departure file. Because if you gonna leave without volunteer departure you will face a 10 yeats of Bar from USA. So its better to apply volunteer departure. Are you in healthcare sector?
