Hello,

My spouse and I are Canadian permanent residents (landed May 2022) but have not yet lived in Canada.

Our child was born in UK after we became PRs, and we want to bring them to Canada while keeping the family together and complying with PR rules.

We have several questions:

1. Child’s entry to Canada:

Can we bring our child on a temporary resident visa (TRV) and then we sponsor them for PR?

Will applying for a TRV trigger a PR residency check for us as parents?



2. Meeting PR residency obligation:

How can we satisfy the 730-day requirement within the 5-year period, given we haven’t entered Canada yet?

Can one parent stay abroad temporarily while the other moves to Canada?



3. PR sponsorship for the child:

What is the correct procedure to secure our child’s PR status from abroad?

What documents will be required for the child’s TRV and PR application?



4. Family togetherness:

How can we ensure the child is never separated from both parents?

Is it safe or feasible for one parent to “reside on paper” in Canada while the other is abroad?




We are all Indian nationals and want to ensure full compliance with Canadian immigration rules while keeping the family united. Any advice, experiences, or guidance would be greatly appreciated.
 
1. Yes, can apply for a TRV in advance. Can't tell you if it will be granted.
2. You can't satisfy the RO at this point. To do so, you'll have to stay in Canada for two years straight. (There is a risk of issues upon entry but probably not super-high).
3. You cannot secure your child's PR status from abroad.
4. I can't guarantee that you will be able to ensure this the way you wish. The way to do that would have been to apply for visas earlier and return to Canada (well) before out of compliance with the RO. Do not understand your question, 'is it safe or feasible for one parent to 'reside on paper' ....' . There's no 'reside on paper', it's a physical day count.

In more simple / general terms:
-apply for the TRV for the child (I assume the child does not have UK passport?). If that's approved, things are easier.
-One or both of you should return to Canada ASAP, with the child if TRV approved. (if the child's TRV is delayed, that may be a sign better for one parent to get to Canada.)
-If one parent is in Canada, and on path to get residency obligation sorted, then will always be possible to sponsor the others (if necessary).
-sponsoring child while out of RO is not ideal - there is a risk of issues or serious delay. But that ship has sailed. If the parent in Canada stays in Canada, will probably be okay. I'd wait in first instance until clear if the child gets the TRV.

How old is the child? You may have issues getting provincial health care (specific rules dependent on province), so get some kind of emergency coverage, and be prepared to pay out of pocket for routine.

Many thanks for this. Kid is very recently born and I just got their passport to progress other matters. We had plans to travel before RO but docs advised against air travel in our case

Would make sure you keep that documentation which should also explain why travel is not advised.
