You can go ahead with this application. You need to submit proof that you and your spouse living separately from 1 year and also submit the proof that you applied for divorce like File Docket number or some court affidavit.

Your situation is pretty much same as of me. You can make an affidavit of separation stating you and your spouse are legally separated now and filing for divorce. You need to give them surety that you don't going to sponsor your spouse in future. For more information, ping me.

I was having pretty much similar case and I got the PR last month. Yes, you can submit petition copy and affidavit from advocate. Additionally submit affidavit saying you will not sponsor ur spouse in future if you reconcile with her and also submit a letter wxplaining the whole situation.

You can file for divorce in court whether she agrees or not so you will get document from court having your file no. or docket no. saying you already applied for divorce. You can submit that document to CIC along with explanation letter that you already applied for divorce and it will take time.
