Hi all,

I just have a quick question, I am PR and I landed far back as 2017, now I am applying to bring my two kids I did not mention in my application and the Visa office has told me I am not eligible to sponsor them because I did not mention them in my application,

They also asked to explain why I did not mention them before in my application within 30 days if not their application will be rejected finally, so can someone please advice me on which tangible reason I can advice.


The only reason is because I had them out of wedlock and did not realize the implication of not mentioning them on my file then. Thanks

That looks like a complicated case. You should seek for legal advice from a lawyer.

How did you get PR? Through which immigration program? There is a pilot for undeclared dependents but whether you qualify will depend on how you obtained your own PR status.

Unfortunately that's not one of the programs that falls under the pilot.

Here's what you need to do at this point: You need to respond to the letter you've received within stated timelines. You should confirm that you did not declare your children in your QSW PR application and explain the circumstances for having failed to declare them. Additionally, ask for humanitarian and compassionate consideration and explain why this should be granted (e.g. hardships you and your children would face if the PR application is refused). It's difficult to say if IRCC will consider your request or not. Technically you can never sponsor your children since you failed to declare them. But it's worth a try.

Quebec has already issued a Selection Certificate for them, and they have also had approval from Federal, is there any way I can use this at my favor for their application or explanation in Dakar?

The CSQ is issued without giving any consideration to declared / undeclared dependents. I don't see how this helps you in any way.

I don't understand what you mean by "approval from Federal".

I mean they gave approval that I am eligible to sponsor my kids. I have already drafted the letter to send but will like to know if you have any idea the Refusal/acceptance rate when you ask for compassionate and humanitarian reason.

Also do you have a clue about the processing times ? Thank You

Thanks for explaining. I understand now. Your approval as sponsor doesn't help the situation in any way. All this does is indicate you meet the requirements as a sponsor. It doesn't indicate that your children meet the requirements to be sponsored by you as dependents.

I don't know the acceptance / refusal rates when you ask for H&C.

If you request H&C consideration, expect the processing will take at least several months. It's really impossible to be any more precise than that.
