I am Canadian and am in the process of preparing the application to sponsor my American Spouse who is residing in the US at the moment. I am confused with the Form 5406. He has grown children living on their own residing in the US. (39-42 years old). Do we need to fill out this form or is this for dependant children only? If we do need to fill out the form, are they required to fill it out themselves and are they required to provide a birth certificate as well? I've searched several different sites and all say something different. They are not immigrating to Canada. They are US citizens. One of the sites said that this form was only for people in other countries, not the US.
 
If children are all well over dependent age, you should not need to. You may be best to include a letter - short - that all children are above 22 and hence not eligible.

Do NOT include these children on the IMM-0008 form.
 
I saw through these email threads that section B should be blank if he does not have dependent children over the age of 18.

Sorry, my mistake on which form you were referring to. That form is quite clear: all children, regardless of age, go in form 5406.

Also, if the children need to be included on form imm5406, do we need to provide birth certificates?

Section B says CHILDREN (include all sons and daughters ... regardless of age or place of residence).

I don't know how they can make that more clear.

You need to list ALL additional family in this form. Children (regardless of age), parents, sibilings. This form is for extra information. There is no need for additional document to proof the relationship.
 
What I find confusing the most is reading all the replies sent from this site. And even though you say that it could not be clearer, then why did someone write this and there are several others that say the same thing.

I would suggest reading and referencing both the guide and the forms together.

This statement is for Applicant's dependant that's aged 18 or older (i.e. 18 - 21) that's under this sponsorship application to fill in FORM 5406.

e.g. your spouse has a 18 years old son and so this son will be included in this sponsorship application.

Your spouse will need to fill IMM 5406 - with all children, sibilings and parents info.
Your spouse's dependent 18 years old son will also need to fill in this form IMM 5406 for HIS information - with parents (yes, repeat what was already filled somewhere) and sibilings info.

I hope this is a bit more clear.
