"During his 2012 Budget Speech, Canada’s Minister of Finance announced that, in an effort to deal with the backlog of pending Federal Skilled Worker ("FSW") cases, the Government would enact legislation to cancel all applications filed prior to February 27, 2008. This is proposed legislation only, but if passed it will be retroactive to March 29, 2012.

Under the proposed legislation, Citizenship and Immigration Canada ("CIC") will close the files of FSW applicants who applied before February 27, 2008, and who have not had a decision on their file made by an immigration officer by March 29, 2012. This proposed legislation is expected to affect about 280,000 applicants, including their dependents."


Holy f*ck, so after having them waiting for +4 years they just cancelled their applications?

If an application isn't completed in 4 years then it's not a regular application. I doubt any applications from 2019 and 2020 would be cancelled. Besides, nobody in this thread (ray of hope fsw 1) has received an ITA let alone made an application, so there's no need to stress. If you read the budget2021 article it mentions the importance of immigration to canada's economy. I can't see why this is causing worry for people without an invitation or an application.
Exactly this. People read one sentence and stick to the absolute worst possible interpretation of it. Maybe they have gender specific draws, or give additional points to females. Maybe they have NOC specific draws, which is essentially what PNP is, so this would just be an expansion of existing PNP programs. So what? Nothing has indicated that they are going to retire FSW overnight. Maybe they drastically reduce the numbers, so maximizing your scores is important. But there may very well be some all program draws this year or next. In the meantime, there is always an option to study in canada, so start preparing for november-march application deadlines. There's a lot one can do if their goal is to be in canada. The path to PR has no doubt become a lot more difficult now, but there is still a valid path, unlike most other developed countries.

Did they give a heads up prior to cancelling the 2008 applications back in 2012?

Whenever I read the speculation about IRCC cancelling in progress applications, my heart starts to sink

folks are reminded of ARRIMA cancellations that happened a couple of years ago. The reforms they meant may have a hidden agenda that would be cancelling FSW-O applications, or maybe FSW-O with targeted NOC draws. :rolleyes:
doubt they'll cancel FSW applications. Targeted NOC draws? possible. Could be a mix of targeted NOC draws and general draws as well. Let's assume 45k ITAs in general draws and 45k ITAs in targeted draws for FSW (the numbers are just random).

I also doubt they will cancel in progress application. Yes, it's been done before (as I posted earlier). But I don't think that's what IRCC has in mind this time. Of course just my opinion.

Cancellation of ongoing applications would be a disaster, remember these FSW-O people paid application fees, and I don't think IRCC plans to refund all of those fees. Given that there had been a large number of FSW draws at the end of 2020 and some services has already been rendered for some applicants i.e. biometrics, forced cancellation looks improbable.

The latter situation with target NOC draws however seems plausible.

As far as I know, Quebec had its own immigration system, and in a matter of a few days they announced they'd cancel ongoing PR applications submitted after certain date in favour of a new system "that would better align immigrants with Quebec's labour market needs" which to me sound awfully similar to the wording of budget 2021 for EE.
Please post with extreme caution when addressing the Quebec point. Your post is overlooking or incorrectly stated the status of the cancelled applications. Quebec process was first come first served and I believe completely paper based. So, just like the Federal did about a decade or so ago, they cancelled unprocessed applications meaning the applications that were submitted but were completely untouched. They only cancelled those and kept the in progress applications (even if one task was ongoing or completed and no decision yet made). As per their law, like @legalfalcon mentioned several times about this topic, Federal and province (Quebec) cannot cancel in progress applications.

So, all the outland applicants currently in progress cannot be just cancelled and decision must be made by either approving, cancelling (incomplete applications), refusing with a proper reason as per IRPA guideline.

I hope I explained it properly.

You know, the articles keep talking about how important immigration is to Canada's economy. I personally even think that these are all indicators of good news. Yes, streams may change, FSW as we know it may get retired, but in the long run I think there will be more opportunities to immigrate to Canada. Why worry when the govt keeps talking about the importance of immigration?
"FSW as we know it may get retired" if this happens then how will Outland applicants migrate ? :rolleyes:

You think anyone can get a student visa when thy are above 30+ , or even a work permit (LMIA)? Spousal is the only possibility for them and that too is time consuming
They've always wanted under 30 people. That's why age points come down every year after 30. Sorry, but that's how it is.
