Hi @legalfalcon
I'm fsw applicant with approved status in gcms since last April and m planning to come to Canada on a trv. My spouse is a Canadian citizen. Will there be any additional documents which I'll have to produce if I get ppr when I'm in Canada like POF? Or any other documents? And will I have to go to my own country to get my pp stamped?? TIA

I meant that the progress bar on my file said that the application is 70% complete and the estimated date for final decision is may 17, 2020.
Thanks
the progress bar that you see only shows time elapsed and not the actual processing on your application.

As per IRCC's annual 2019 annual report it takes 8-9 months for an application to process. This was pre-COVID
https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/annual-report-parliament-immigration-2019.html

How long did it take to process an Express Entry application?
Table 35 displays the time, in months, that IRCC took to process 80% of applications under each program. In 2019, IRCC did not meet the processing standard of finalizing 80% of all applications sourced via Express Entry within six months. The processing time for Express Entry, overall, was eight months. As an alternative measure of processing times, 60% of applications finalized in the 12-month period ending on December 31, 2019, were completed within the six-month service standard.

Most applications now take way longer.

IF you file two PR applications, the one filed later will be placed on hold until a decision is made on the first one or it is withdrawn. This is done to avoid duplicity of work.

Also, filing a new application will not expedite it or guarantee that it will be processed faster. The new public policy is just another pathway for PR.
I think you mean for the same pathway. I know people that had two PR application processing at the same time (Paper based PNP and EE) and the second one (EE, for example) is running faster. That is my case as well.

Hello @legalfalcon
My wife had 2 visas to Canada refused, 1 when she applied for visitor and other recently as Sowp extension. Our PR application is in progress since 7 months, my questuon is,
Will it impact on our application or her secirity check will take longer than mine? Will that also fall under dual intent category negatively? Since she recently applied for TRV and our EE PR application is in progress with me as PA.
Thanks in advance.

A TRV rejection has no bearing on the processing of your PR application as long as you have disclosed it.

Here are my old posts on these issues:

For dual intent see #5,214

______________________________________
TRV and PR applications:

Any application you file can be looked into and there should be no discrepancy. If you filed a TRV in which you did not declare a job, and then you claimed a job in your PR application, this is a discrepancy. The issue here is whether prior TRV application in which an employment detail was left out can be added to the PR application, and would this inconsistency be of any concern.

The answer is simple. If you file any application with IRCC, TRV, WP, PR etc, any of them can be looked into to review your current application and any inconsistency can be a cause of misrepresentation. All applications have to be consistent, and if they are not, a reason on why you omitted the information has to be provided.

Now I will not be deliberating that if the prior application was refused, why it should be looked into again, or you file a TRV before and you did not disclose an employment but subsequently claimed pints for it in PR and got a PPR without any issues. This is all anecdotal. Just because someone was not caught, does not make him innocent.

They law is clear, while applications for different types of status engage different considerations, it does not necessarily flow that statements made in temporary residence applications cannot affect subsequent permanent residence applications (or vice versa). In Suri v. Canada , the court found that the Officer’s concerns vis-à-vis the contradictions between the Applicants’ temporary and permanent applications were reasonable and based on that the applicant's misrepresentation ban was upheld.

Federal courts have ruled on this numerous times.

Read - Suri v. Canada available at http://canlii.ca/t/grvwt

Similarly, in the case of In Goburdhun v Canada (Citizenship and Immigration), 2013 FC 971 at para 28, Justice Strickland summarized the key considerations outlined in the jurisprudence, including the fact that paragraph 40(1)(a) is to be given a broad interpretation, capturing misrepresentations even if made by a third party such as a consultant, without the knowledge of the applicant (see also Wang v Canada (Citizenship and Immigration), 2015 FC 647 at para 25). The only exception to this rule is narrow and applies in the truly extraordinary circumstances where an applicant honestly and reasonably believed that they were not misrepresenting a material fact and knowledge of the misrepresentation was beyond the applicant’s control.

You can read the above judgments, they are available online.

If there was a discrepancy on your applications, you should have addressed it in your LoE with your PR.

There is nothing known as running faster. EE electronic applications are processed faster than the paper based application anyway. For paper based PNP applications the the processing time is 15-19 months.

And for each application you file, the security, criminality has to be re-done.

If you know people who have have done it, and you have another 1-2K sitting to spurge on immigration, it is your money, your application, your decision. However, immigration is based on law and not on what happened to other people's application.

IRCC for its citizenship applications clearly states:

Policy
CIC has an obligation to avoid duplication of work or unnecessary costs in the processing of an application. Unless a client specifically requests CIC to process two or more applications at the same time, all applications will be held by CIC until processing on the initial application is completed. Applicants are encouraged to submit new applications only if they have new facts or evidence.

Hi @legalfalcon ,

With your knowledge and experience a post to explain the recently announced new pathways will be of great help.

Especially reading a lot of CEC candidates who have got ITA and even submitted and waiting for approval of PR, considering to also apply under the new pathway. Not much details are out yet. But do you think there will be some way that IRCC may make sure the applicants who have not already applied /waiting for approvals do not submit another application, so that more eligible candidates can apply ? Or would that be an option they would leave to the CEC applicants to also choose this new pathway.

Looking forward to a detailed post from you soon !!

If you are in Canada, you will have to inform IRCC that you have changed your country of residence and provide IRCC with your new address. For applicants who are in Canada, they are sent a COPR which is stamped and signed.

As regards documents, any documents can be ask while the application is being processed, which is at the discretion of IRCC.

There is no bar that you cannot submit more than one application. Which one will be processed faster than the other, is something that will depend on IRCC's policies. Also filing another application under the policy does not mean it will be processed faster since all the checks like criminality, security, eligibility will have to be done again. For applicants who just submitted their application, they may benefit from submitting another one under the new policy and withdraw the one they submitted.

Fo those who have their applications in process for the last 4-6 months, they may not see any benefit and will have t wait for another 4-6 months, and they may even have a decision on their previous application faster.

Also, each application has to be accompanied with a filing fee. So if an applicant has another 1-2 K to splurge, then sure they can submit multiple applications.

Client Support Centre
The IRCC call centre provides services in Canada to those who have submitted applications from within Canada or online in two forms: an automated service available at all times as well as Call Centre agents who answer calls, in English or French, Monday to Friday from 8 a.m.to 4 p.m., local time. They are not available on weekends or statutory holidays. Dial 1-888-242-2100. After the recorded introduction, you will be asked to choose a menu option. For those who are outland many have found success in calling CSC using apps like TextNow after obtaining a Canadian phone number.

IRCC manual (a page below) mentions that the call centre agents should have a "smile in their voice" when speaking with clients. Be sure to smile back!

Please let me know.
If you have a TRV you can travel to Canada. When you receive the COPR and PRTD is not known. However, if you are in no rush and would like to stay back in the country you are in, you can surely wait. But how long the wait would be is not known.

If you have rejoin your job, then it is advisable that you return before your visas expire, and you apply for an extension so your TRV or apply for BOWP.

Hi @legalfalcon
Thank you for your response. So I have another question.
In the waiting time of ADR (RCMP) to be submitted, and of its status after uploading change from 'uploaded' to 'in review', my file is still processed at backend or it is put on hold completely?
Again, thanks for your time.
