Hello all,
I have a Bachelor Degree in Finance and applied for a 2-year Diploma and coop for Business Marketing, at Algonquin College in Ottawa. My application was refused yesterday with these reasons:
• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on your travel history.
• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on your family ties in Canada and in your country of residence.
• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on the purpose of your visit.
• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on the limited employment prospects in your country of residence.
• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on your personal assets and financial status.
----------------------------------
I should mention that the studies start in September 2021 and I applied for the Study Permit on January 14th. Do you think this is a reason I got rejected? If yes when would be the best time to reapply?
Im sure all the reasons mentioned by the officer dont make much sense regarding my application. I surely have travelled to at least 5 EU countries in the last 5 years. I do have a sister living in Ottawa, but I showed strong ties to my home country and also submitted a letter from my work manager stating that the studies will help me to advance in my job and they'll be happy to rehire me once I finish my studies. I applied along with my spouse.

Please give me some advice on how I should proceed? Do I have better chances if I apply alone? T
Thanks in advance.

Your choice of study makes no sense. You are taking a step backwards doing a diploma in business. Your choice of degree must lead to career advancement. If you want a better chance of approval do a masters degree. The fact that you applied for EE contradicts your statements that you intend to return home after your studies.

The course I will take at Algonquin is actually very good and I have explained how it will enhance my skills and why I need to take that course.
I have a doubt that they havent even looked at my application and refused it since I have applied very early :/

You may feel that it is good but an employer and IRCC will focus on your bachelors not a diploma because it is a more advanced degree. The fact that you attempted to secure EE invalidates your claim that you intend to return home after your studies. I would order GCMS notes to know the exact reasons for refusal.

You are right. I will order the notes, but I dont think I will get useful insights. Also, do you think that if I apply alone, not with my husband accompanying me, I will have a better chance of getting the visa?

What is your degree in? Taking a diploma course after a degree may not show career advancement. You need to show why the program will help you with a job in your home country. Again you don’t have the funds if your sister is paying.

If I get an affidavit from my sister will it make any difference?

Your sister must show proof of her extra savings.
Sounds good. Also, do you think its safer for me to apply alone and not with my spouse accompanying me, even though I included him in the first application that for refused?

I have almost same case as yours, but still haven't got the results back, I applied on Feb 3. I have bachelor in English language and applied for diploma in IT business management. I didn't include my wife in the application and provided strong explanations about why choosing a diploma, but I think I will get the same refusal results as yours. I believe excluding your spouse is better in such applications. They think you are both going to stay there after your studies. Also, you have chosen same city as your sister's residency, that would make some doubts too, choose a cold place like Calgary next time.

It's not about the course being good or not, it's about whether it makes sense for you according to the perspective of immigration. Most people who apply for a lower qualification than they already possess have the intention of remaining in Canada, so you're putting yourself clearly in that category.

You should apply for at least a postgraduate qualification of some kind. You have practically zero shot of an approval with this current course.

Apart from that, you've been flagged for pretty much every reason possible, it's going to take a lot of work to assuage their concerns on all these factors.

But the first step is definitely to change your course of study to a postgraduate qualification.

Get your GCMS notes, It will clearly explain the root cause of your visa rejection. Visa Officers cannot reject an application without proper reason. Reapply after discussing your case with an experienced immigration lawyer. Your sister can help you with this as she is already in Canada.

Have you ever shown an intention to reside permanently in Canada? Or changed the purpose of visit from your previous applications, if any? It looks like the officer is convinced that you are not leaving Canada after your studies and states all possible reasons to support his/her opinion.
