Hi, I am in currently working full-time in Toronto under an Open Work Permit. I could start my PR application through the Canadian Experience class based on the fact that I meet the requirements. However, I got married in November 2020 and my spouse is a Canadian citizen. I understand the Inland Spousal Sponsorship program is available and I could apply for the PR through it. But I am worried about my current status as a worker (I work full-time in a permanent and stable job), could my Open Work Permit be affected in any way? Should I go ahead and apply for my PR through Express Entry instead?

Thank you for your comments!

How many points do you have under EE?

Your OWP will not be impacted by submitting a spousal sponsorship application. You would simply apply inland and include an OWP application with that application. You can continue working full time like you are now and even continue working once your current OWP expires due to the OWP you submitted with your inland application.

I would have around 508 points under Express Entry.

So, I need to include an Open Work Permit application in the In-land Spousal Sponsorship Application even though I already have one, right? Would the new OWP one replace the old one? Sorry for so many questions, it's just that I could not find any information regarding this specific case on the web whatsoever.

I also checked that the Express Entry application would be more expensive than the In-land Spousal Sponsorship. However, the latter takes longer than the EE. Any advice on which I should apply?

Thank you!

It's really up to you which path you take.

For the 508 points, make sure you aren't counting the 50 job offer points (unless you have an approved LMIA) and also make sure you aren't counting any points for your partner.

The OWP with the inland application will allow you to keep working after the OWP you have now expires. You can also hold off applying for the OWP and just submit the inland spousal sponsorship application.
