Not true. If you have served in the military or had a government job, it will be the nature of the government job that will determine what kind of security screening your application is subject to. Only applicants who have specialized military training, who have worked in intelligence services, chemical and nuclear warfare training etc. may be subject to Moree stringent security screening, which may take additional time.

To read on how the security screening is done, who does it, when it starts and whether your security screening is subject to a record check or a comprehensive check, see https://bit.ly/3oU5eN9
Thank you

@legalfalcon Thanks a lot! In my case, I passed all the assessments and just waiting for the final decision. Let's say that they took more time to finalize my application, beside asking for new medicals and a non expiring passport, would they also ask for something else? Like new PCCs or new documents? Or since i passed everything thing, the only two things they might ask for is only a new medical or a valid passport?

During the processing of your application IRCC can seek additional documents as need be. However, once an application has been approved, you only have to submit your passport which should be valid for 6 months or more.

@legalfalcon I always appreciate your help and support. Can't know how to thank you really!

In general, with a guy who passed eligibility, criminality, and security, and medical, what kind of documents they may ask for to submit again if the processing times took some long time due to covid-19?
Can they ask, for example, for new PCCs once I passed my criminality? Or it's unlikely to ask for something else one I passed all the eligibility, security, and criminality stages,

And, for how long, does the passed eligibility, criminality and security stages remains passed? Does those "passed" status of eligibility, security, criminality have some expiry time by which they had to be reassessed again if the processing time got too long? Or once they were passed, they will remain passed regardless how long the processing time will be?

I know I am asking a lot but I trust in your help!
Thanks again for your patience!

@legalfalcon

I would really appreciate if you could provide your expert opinion on my current situation:

My AOR is May 30th, I called IRCC and they said everything seems to have passed and they told me to wait for the final decision. I am bio-exempted btw.

Now I stopped working for the employers I claimed points for (2 - part time NOC-B for 13 months each). And I stopped working after 1 month of getting my AOR.

Later, joined another company and worked for 8 months as a full time employee (NOC B). And starting last week I joined my new employer as a Full time employee where I will work as a permanent employee (NOC might fall to C but it's a better paying corporate job).

So do I have to inform IRCC about the 8 month employment at a BPO or should I inform them about my current employer or should I inform about both? If I have to inform them, how can I do that?

I was also planning on leaving Canada for the next 3 months (my employer already gave their permission but nothing confirmed yet), would it create any problem for my PR application?

Please let me know what to do! Thank you in advance!

Technically IRCC can ask for any document again during the processing. However, if your eligibly, criminality, medicals and security have passed, then most likely you may only be asked to re-do the meds if they have expired, no other documents would be asked.

Once the stages are passed, they will remain that way unless IRCC detects significant change in circumstances, or there has been extraordinary time lapsed from when your documents were originally issued.

Are your FSW / PNP or cEC?

Hello again @legalfalcon
I am an outland FSW applicant and I have submitted my application since one year and the delay is due to covid 19 and as of now, as I said, i passed all the stages...
Taking into consideration the covid 19 situation, how many months is considered an "ordinary processing time" for outland applicants?
Can we say that if the processing times exceeded two years for current outland applicants, it will become extraordinary long?
When the processing time is considered to be extraordinary long? How long will it be?

If you claimed points for the job you have left, you should inform IRCC that you no longer work there. It will have no impact on the processing or your points, but IRCC should be aware that you no longer work there so that if any verifications are done, IRCC will be aware that you are no longer working for the employer.

You do not have to inform whom you work for now, but just the fact that you no longer work for the employer for which you claimed points. This is if you did not claim points for arranged employment.

Also, you can leave Canada at anytime. If you leave Canada and change your country of residence, inform IRCC and update your address, so that when your PPR is issued, it is sent with the correct instrumnctions.

If you are leaving Canada temporarily, then there is no need to inform IRCC or change your address.

Thank you so much @legalfalcon. How should I inform IRCC? Via the webform or any other way?

Usually, some applicants who were stuck in security screening, their application took more than 2 years in some cases. These applicants approached the Federal Court seeking mandamus (i.e. asking a direction from the court to instruct IRCC to finalise their security screening) and make a final decision on the application.

The Federal Court in Apotex Inc. v. Canada (Attorney General) [1993 CanLII 3004 (F.C.A.)] laid the criteria when the write of Mandamus can be issued.
  1. There must be a public legal duty to act.
  2. The duty must be owed to the applicant.
  3. There is a clear right to the performance of that duty, in particular:
    1. the applicant has satisfied all conditions precedent giving rise to the duty;
    2. there was:
      • a prior demand for performance of the duty;
      • a reasonable time to comply with the demand unless refused outright; and
      • a subsequent refusal which can be either expressed or implied, e.g. unreasonable delay.
  4. No other adequate remedy is available to the applicant. (5) The order sought will be of some practical value or effect.
  5. The order sought will be of some practical value or effect.
  6. The Court in the exercise of discretion finds no equitable bar to the relief sought.
  7. On a “balance of convenience” an order in the nature of mandamus should issue.
As such there is no time frame exceeding which the daly may be called extra ordinary, but it more of a factual question and comparative with other application.

When to order GCMS notes?

The GCMS refer to the programmed called Global Case Management System (GCMS) used by IRCC that holds the entire processing record of your application, including the the notes pertaining to eligibility by an officer evaluating your file.

All applications go through the following stages: <https://bit.ly/3tDBFDl>

R10
Medicals
Criminality
Eligibility
Security <https://bit.ly/3apWglN>

R10 or the completeness check is the first stage of the processing, wherein it is verified that your application is complete and all documents are submitted. Filing a complete application is the responsibility of the application, and if a document is missing, a reason and an exemption request should be filed.

If an application is incomplete, it will be rejected. R10 usually happens within 30-45 days of filing your application, around the time when medicals are passed. The exact date will be available in your GCMS notes.

There is no point requesting GCMS notes at this stage, since if your application is incomplete, it will be rejected anyway, and for the medicals, the MyCIC account does inform you of when your meds are passed.

GCMS notes become important only for the eligibility stage, which does not start until 3-4 months. Eligibility takes place in 2 stages. First a case assistant or an analyst will review and make a recommendation. This is then reviewed by an officer who makes the final decision on the eligibility. Since each document you submitted has to be reviewed twice, this is the most time consuming stage.

Only for this stage are the GCMS notes relevant.

As regards RCMP, not all applicants are required to provide RCMP. If your spouse was not asked to provide a RCMP, then you don't have to.
