  • I am a student who has completed a program of study that is a prerequisite to my enrolment at a designated learning institution with visitor status in Canada; or
  • I applied for permanent residence and was found eligible (first stage approval) under one of the following classes:
    • Spouse or Common-law Partner in Canada
    • Humanitarian and Compassionate cases
    • Protected Persons in Canada
    • Live-in Caregiver in Canada
above question's answer should YES in our case right?

Lastly, I have also attached the history of Education and Employment from the past 10 years as there is not enough space to add to imm5710e. (Appendix I: Education, Appendix II: Employment history from the past 10 years)

Hey Guys, i have one question, i am eligible for both BOWP and Public policy, which one i should go for as i have already submitted my PR file, if i opt for public policy is there any possible negative outcomes or no? please share your valuable suggestion

Go for public policy because the BOWP is dependent on your PR application. The public policy is dependent only on your PGWP

You have to be in Canada to apply. Unfortunately I don't believe you will qualify since you must have been physically in Canada on January 27th according to the rules to qualify.

It doesn’t make any sense if someone is travelling outside of country and has valid pgwp can’t apply. Specially when I normally live in Canada.

I'm just going by the details on the website. These instructions seem to make it very clearly. Specifically this bit below:

Who can apply
To be eligible for this open work permit, you must meet the following 5 requirements:

  1. Your post-graduation work permit (PGWP)
    1. expired on or after January 30, 2020, or
    2. will expire within 4 months from the date you apply for this open work permit.
  2. You were in Canada as of January 27, 2021, when the public policy took effect, and have stayed in Canada since then...

Yes, you still qualify because your primarily based in Canada and have a valid PGWP. Just because you take a vacation out of the country which you are eligible for, doesn't disqualify you from the policy.

You have until April 2021 when your current PGWP expires to apply and should be present in Canada.
