Hi everyone,

I am currently in a dilemma and trying to figure out a way to process my mother's immigration through sponsorship. The biggest issue I have is that my father who is currently in Pakistan is not willing to let me even process the immigration documents let alone going out for bio metrics or medicals. Is it possible for me to file immigration for only my mother?

Is there any way out? Would my mother's file be rejected if I only file her case?

I am a Canadian Citizen and qualify to meet the income threshold. At the moment my mother is with me in Canada on a Visit visa which is valid for 10 years. I am certain immigration officials treat temporary visas differently to immigration ones.

Appreciate everyone's insights and comments.

He needs to complete and pass a medical in order for the application to be approved to sponsor your mother. You can only exclude him if they are divorced or you can prove they have legally separated.

Yes, her application will be rejected if he failed to do the medical.

Thank you Scylla for the detailed response. I thought the same but wanted to get a second opinion on it. Honestly speaking my parents are not in good terms which explains the conundrum I am in. Mother wont budge discussing seperation or divorce due to cultural norms and the stigma attached to it in Pakistan.

I am in a fix at the moment as I do not want to spend 2.5K every year for her Supervisa Insurance when I can easily sponsor her for immigration. Appreciate your input Scylla. Thanks

Would at least wait to see if you get one of the spot if and when the program opens up again. They are going to make changes about who qualifies for a spot based on 2019 and 2018 issues. There is very large demand and only so many spots because Canada can only absorb so many parents given that it already has an ageing demographic and since the PGP. Would warn you that there are also expenses associated with being a PR. There are many things that are not covered in Canadian healthcare system. One of the easiest examples is a spot in government subsidized longterm care. Children of PGP applicants are expected to pay +1k/month for a spot. Costs vary between provinces, whether shared room or private room, etc. Those who have lived and worked in Canada longterm transfer their government pension income to the home which is not an option for PGP applicants. There is also the cost of things like dental care. It can be extremely expensive. There are still plenty of costs to be considered even if you no longer have to pay for supervisa insurance.

Good luck! They delayed the pgp sponsorship because of Covid. I am hoping that they’ll release by April next year. You have enough time to convince your father for Medicals.

That's an interesting take on the whole situation. For me the benefits of PR outweigh the risks especially related to travel. I have family in down under and it would be easier for her travel than applying for visitor visas and getting rejected due to a weak passport. Also the only cost which kind of bothers me would be that of prescriptions. Anyways I have to take this with my mum as there are absolutely no chances of acquiring PR as a single applicant without my dad on board. Thanks

I was in a similar fix when I applied for both parents supervisa and my dad refused to go out for medicals and only my mother completed it. The visa office delayed the application by almost 6 months and actually gave me additional time to allow for dad's medicals which he refused all 3 times. In the end they granted supervisa to my mother and not my dad.

I am actually willing to take the risk and thinking to move forward and apply for PGP hoping they would accept it. Lets see, fingers crossed.

It will be up to CIC but that is unlikely to happen because allowing your mother to get PR without your father doing a medical would mean that he can be sponsored later on even if he has an expensive condition to treat. Others have tried to do this when they know one parent is going to be inadmissible. Supervisa is still a tourist visa so there aren’t the same potential repercussions. Perhaps your mother will change her mind about divorce if she knows PR won’t be a possibility

If they approved last time, I am sure they’ll approve her PR as well. As you mentioned, the only bummer is that it might take more processing time than usual. Also with IRCC, a lot depends on where the file goes ( visa office) and who’s handling it.

Disagree. Approving someone for a supervisa is very different than PR. If the mother gets approval on her own she can then sponsor the father. Others have tried to do this because one spouse has a medical issue which would cause them to both be denied. They can certainly try but wouldn’t count on the same process as supervisa.

The requirements are actually very different for a visitor visa vs. PR as it relates to medicals for dependents. If you want to exclude your father from having to do a medical, you'll need to prove your parents are no longer together and be able to exclude him from the application entirely. There's actually a very logical reason why it's mandatory for both parents to complete the medical as part of the first application (even if only one is immigrating). This has to do with medical admissibility and the requirement that all dependens (even non-accompanying) be assessed as part of the application and pass the medical in order for the primary applicant to be approved.
