Common Law Visa

Hello,

As some of you may know me (from UK) and my Canadian fiance have have sent our application for the common law visa, which can take up to or around 12 months to be approved, along with the PR.

However, I am planning on going there in November on the 6 months visitor visa (ETA), I am just now wondering do I tell the guy/girl at the border that I am coming to Canada and waiting for my Visa to be approved (hopefully within the 6 months) or do I just say that I am visiting my girlfriend.

Also, the only problem is and which they may seem alarmed by is that I'm only planning on buying a 1 way ticket as I hope that the visa is done by then and even if it isn't I will extend it till my PR or Visa is approved.

No it won’t influence processing times. You also can’t sponsor anyone until the 5 years is over

Currently the airline will need to be convinced to fly or you won’t be able to board. Unsure how long restrictions will last.

You can not travel to Canada as a Fiance, you can travel as common law. If they ask you, you have to tell the truth.

I thought I can fly to Canada from the UK currently?

you can travel as common law if you have enough proof that you and your partner have physically lived together for one continuous year or more.

It is up to the airline whether they believe you are common law or not. Nobody can guarantee whether you will be able to board or predict what degree of proof will be required. Would contact the airline and ask them what kind of proof they are looking for.

Will contacting the Airline help, I though it would be the border people that would make the decision?

Also, do you know if it's allowed to wait in Canada on the visitor visa whilst I wait for the common law/PR to be approved?

The airline does the screening and may contact CIC if possible before boarding if there are any concerns before boarding thr plane. The airline has quite a bit of discretion because they will need to pay to repatriate someone who is denied entry into Canada. Proving common law is especially difficult especially when you don't have very simple concrete proof like joint leases for at least a year.

Well we have plenty of other proof other than the lease, hopefuly it will be enough for the visa in general as well as entering canada whilst the borders are closed.

Scared me a little now that without a lease I won't get the visa/enter the country haha

No, I doubt it and I hope they don't. Winter will bring influenza, and we don't yet know how that will fuel the current epidemic. I am guessing that towards spring next year things will start going back to normal (new normal), but that's just a very personal guesstimate.
