Hi guys,

I would really appreciate some thoughts about our case as it has been very stressful and I am not sure if the evidence I have would satisfy CBSA/airline to let me enter Canada.

I am a common law partner of a Canadian citizen. We have been in a long distance relationship and visiting each other’s country since Dec. 2015. We cohabited for 1 year (Jan 2019-Jan 2020) in Canada while i was on a Working Holiday Visa. After this period I went back to my country (Greece) and my partner joined me two weeks later. We were planning to spend 3 months of vacation in Greece and then fly back to Canada together and start my PR application inland. Our initial flight back to Canada was scheduled for April 2020 but it was cancelled and my partner returned to Canada on May 24th but I couldn't join him due to the travel restrictions.

As for documents we have gathered to prove our common-law are: 8.5 months rental agreement under both our names + letter from landlord, 3.5 months letter from my partner’s parents stating that we were staying with them at their house in Canada and contributing financially, Joint bank account in Canada with savings, Bank statements that show transactions between our accounts, Solemn Declaration from my father stating that my partner was staying in our house in Greece during the lock-down period as it was needed for his Visa extension in Greece, Supporting Letters from families and friends, Photos of us in many of our trips together since 2015, Airline itineraries + Passport Stamps between Canada – Greece since 2015, Cards that our families sent to us, Proof of communication between me and my partner and his family since 2015, Receipts that we were paying each others hotel rooms etc

Unfortunately we don’t have a Statutory Declaration of Common Law and no bills under our names (shared utilities).

The question is should I try to book a flight for August or is it too risky due to lack of documentation? TIA
 
Given that you don’t have proof showing a 1 year lease with both your names on it including mail with both your names on throughout that time it is going to be difficult to prove your common law status. Unless you have a lot of clear proof of common an airline employee is unlikely to take the risk of putting you on a flight because they are responsible for getting you home if you are denied.
