Family Class Spouse PR Application Mail/Courier from India - PA and Sponsor both in India

Is it possible to mail OR courier Family Class Spouse PR Application to CPC office in Canada from India with following condition :
- Sponsor is visiting family in India during the time and due to COVID-19 situation would like to stay in India longer
- Principal Applicant also in India

So we don't want to wait longer and would like to send application to visa office.

We have application package ready to send, just want to confirm if it can be mailed OR couriered from India to CPC office in Sydney, Nova Scotia.
If anyone has done this before while Sponsor is in India ?

Please provide any help , suggestions.

Yes Sponsor is PR on his own, and has a current job in Canada, working remotely from India
He needs to wait until he is back in Canada. As a PR, you must be in Canada in order to sponsor and only short trips (2-3 weeks) outside of Canada are allowed without putting the application approval at risk.

He should wait until he is back in Canada to send the application to make sure there's no risk IRCC will say he's not living in Canada and doesn't qualify to sponsor.

This rule applicable only to PR holders. Not for Canadian citizens.

The only way out of it is to wait until he has moved back to Canada to apply.

If he has to stay with his family for some time, then sponsorship will not be possible for some time. Again, he needs to wait until he has moved back to Canada to submit the application.

I know, but WHY not for PRs ! ??

Why to force someone to stay away from their family in such times even if he is meeting all other criterias to Sponsor very well !
And is ready to return to Canada once things get safer to travel in this COVID situation ?

Are you 100% sure this will turn in refusal if application is sent to CPC from India while Sponsor is in India ?

Note: The spouse applied for Visitor Visa earlier back in December 2019 and got rejection. But that was applied under a different person (another relative of her) sponsoring and inviting her for visiting Canada.

What are the chances of her Visitor Visa getting approved ?

That's just how the rules are. PRs are required to be living in Canada in order to sponsor family members for PR.

If you submit the application from outside of Canada and then remain outside of Canada for an extended period of time, the application is going to be refused. There's really no point in applying.

Canadian citizens are given greater flexibility due to their citizenship status and are allowed to sponsor family members while living outside of Canada. The same rule does not apply to PRs. PRs are required to be living in Canada and must avoid any long trips outside of Canada during the sponsorship process.

Yes - the spouse can apply for a TRV. Generally speaking the chances of refusal are typically quite high since IRCC often assumes the spouse isn't a genuine visitor but wants to remain in Canada long term. However you can certainly try. Make sure you declare the previous refusal in the new application.

It has been Longer... I came here in Mid March and since then I am here due to COVID-19 situation. As it was not safe to travel back since last few weeks only. Still it's not safe but travels are open now.

It has been Longer... I came here in Mid March and since then I am here due to COVID-19 situation. As it was not safe to travel back since last few weeks only. Still it's not safe but travels are open now.
That's far far too long. You're going to be refused if you submit the application now. You really need to wait until you are back in Canada.

The residential address bit is irrelevant. PRs need to be physically living in Canada to qualify to sponsor. You've been out for months.

Sorry - I know this isn't the answer you want to hear. But I think better to know now rather than ending up with a refusal.
