Hello everyone,

I have a situation with which I need a bit of assistance.

My gf and I applied for Express Entry as Australian Common Law partners and it was granted last year. It'll be a year since PR received in a couple of months. She was the main applicant and I was the dependent.

Now we wish to cancel our Australian Common Law but are unsure how it effects our PR status in Canada. Also do we need to inform any department in Canada about this? What happens if either of us get into another relationship or want to get married?

Any information on his would be highly appreciated.
 
If you're both PR and agree to break up, in Canada you just break up. If there isn't agreement, common law partners can resort to family law for division of assets, like a divorce.

Your PR status is not affected as you are already PR. You don't need to inform anyone in Canada, aside from the Canada revenue Agency for tax purposes.
 
We don't wish to divide any of the assets or anything like that. The break up was amicable and we don't wish to create any issues for each other.

So if either of us get into another relationship and want to get in registered in Canada, our previous relationship won't effect the registration of the new one?

You are required to file taxes as common law when you are common law. Now that you're single, you are required to update CRA within 30 days.

A previous common law relationship will not affect future relationships legally.

When did you both move to Canada? When did you become common-law?

If you both came to Canada when you got PR last year, you will be required to file as common-law for your 2019 taxes. If the relationship ended in 2019, you have to file as common-law up until the point in 2019 when it ended.

She's still in Australia but we did our landing last year. I am in Canada now. We became common law in 2015 or 2016.

We only need to file taxes if we generated income in Canada right?
