Why are You thinking of applying when You applied under CEC already?

Just to be on safer side. I meet every requirement expect arranged employment. Even if I don't include arrange employment I end up at 82 points. I am just not sure if I can apply because I am on open work permit. I haven't got LMO.

Lol me too, Im on Open work permit too :)

I'll go and see a laweyer in next few days, and ask for advice. Regarding to CEC, and FSW program too.

No you cannot apply under Federal Skilled Worker program if you don't have a LMO, as you are currently on an open work permit. Your application will not be placed into processing.

If you have more than 6 months left on your work permit, you can move to another province (if you are currently living in Ontario) and apply under their PNP. Bear in mind that it takes some time to receive your nomination and that you can apply for your BOWP only after you receive your nomination or AOR from CIO.

Alternatively, you can check with your employer if they will apply for LMO on your behalf. If so, then you can extend your stay and possibly apply for PR under PNP (under your current province).

My work permit expires on may 31st, so there's no time for moving. I guess I'll have to talk about my reference letter with my boss. Seems like my job is something between 1211 and 1215, since I work in trucking company. Im not sure If I can put both of those NOC codes in my reference letter. :o

The only part thats confusing me is whether I need LMO or not? and another thing I heard is you can apply without LMO if you are under categories they introduced (specific occupations not every occupation in O,A & B). If its not mentioned then I need LMO. Can someone confirm this?

You are right, Jes! I was checking other codes, and 7305 is perfect NOC code for me. It explaines exactly what my job is.

I need to wait till may 6, and I'll apply under 7305 NOC class.

A little bit off topic but I see my NOC code is 2174 and my colleague's NOC is 2171. We are doing the same work and company applied it different NOC codes for us. Any idea how advantageous or disadvantageous is that?

Great! Now the trick is to make what your manager wrote look a little bit more like the NOC. You can show your manager the NOC, but what he writes cannot be identical, it cannot be cut-and-paste. You can tailor it to your exact situation. But the supervisory duties do have to be made more clear. Good luck!
 
If you are on an open work permit, you require a LMO to apply under Federal skilled worker - arranged employment stream. There are no exceptions to this rule. However, if your occupation from your previous work experience falls under the 24 eligible occupations for FSW and the cap has not been filled, you can apply under FSW (not arranged employment stream).

Since you have already received your AOR for CEC, I don't see why you'd want to waste your time and money on applying under FSW. It takes longer and there are more documents to submit. Just wait for your CEC to work out. :)

If a person owns and manages a transportation and logistics business since last 25 years back home, (42yrs old) could he immigrate under NOC 7305 (NOC B) on a LMIA based work permit? Currently, he is managing operations of around 20 truck drivers. Any loop hole or word of caution?

It is not clear if you are asking about a work permit or to immigrate as a permanent resident (PR)?

Note that since the person in question owns the business, it will be considered self-employment. Self-employment counts as foreign work experience, but it can be more challenging to document for PR applications.
