Hello, I am in dire need of assistance regarding how to go proceed with our situation. My partner is in the middle of waiting for his PR application to be approved (applied through Express Entry under the Skilled Workers Class). He has already received an invitation to apply and is waiting for the processing to complete.

His work permit expired last November 26, and we were under the impression that since he was already asked to apply his status was implied. We received an email from IRCC today asking for an explanation as to why he has not yet applied to extend his work permit and are at a loss as to what to do. After further research it appears we made a mistake and he did in fact need to apply for an extension before his work permit expired. We're expecting his application to complete processing by February.

If he returns to his home country now til then, he may be asked by the state to serve the military for 2 years which is what we're trying to avoid. We're not married, and are considering if this will help us keep him here through another channel.

I would sincerely appreciate any help I can get with this.

If he's still working he needs to stop immediately. Right now he is out of status in Canada and not entitled to work.

He should apply to restore his status to visitor asap. He has 90 days to do this from the time his status in Canada expired. However you don't want to wait - apply now.

Assuming the restoration application is approved, he will be able to remain in Canada as a visitor to wait out the processing of his PR application - however he will not be entitled to work.

Thank you so much!! This is exactly what we needed. We're in the process of applying right now. Would you by any chance know how to go about it? We tried to apply online but it's giving us an error on the part where it asks for the date when his work permit expired.
