Hello

I currently have an open work permit and I have been working full time for two years for the same employer in Canada. I am an engineer and this is my primary job.
I do not have LMIA and my employer will not provide one.

My question is, do I need an LMIA?

You only need an LMIA if you want to claim this as a job offer to get 50 points under Express Entry. Otherwise you do not need an LMIA.

I do want to claim this as a job offer. I thought if I had an open work permit and if I had at least one year of full time job in NOC skill level A then I don’t need LMIA.

No - you've misunderstood the rules.

That only applies if your employer is named on your work permit - such as in the case of an ICT where no LMIA is required but it is a closed work permit with your employer named.

If you hold an open work permit, you need an approved LMIA to claim what you have as a job offer and get the 50 points.
