Hello everyone,


I need guidance on my current situation. Me and my husband are in canada. He is on study permit and I am getting eligibility in CEC to apply for PR. I would like to apply individual and do not accompanying my husband. In this case which documents do i need from him while doing a file or after getting an ITA.

You will struggle listing your spouse as not accompanying if your spouse remains in Canada. We have recently seen IRCC crackdown on this if the spouse is in Canada.

Also note that whether accompanying or not, he still had to provide all of the same forms, documents, PCCs, etc.

Based on your previous post of https://www.canadavisa.com/canada-i...d/threads/need-help-in-this-situation.641859/ it seems likely that your relationship has not improved to the point where you want to include him in the PR application at all.
You need to consider the options available to allow you to do this, such as a full separation or divorce. Otherwise, you will need to include him, even if you declare him as non-accompanying.

The issue is she is likely to be refused if he is in Canada but listed as non-accompanying.
 
Looking at your previous posts were you living together before you got your SOWP? It says you had not spoken in 4 months. The SOWP is so that couples can be reunited. Had IRCC known you were not living together a refusal would have been a possibility.
