my co worker is scared to talk on forums and is very nervous and upset because he got his confirmation of permanent residence in the mail but last week was charged with possession with the intent to sell :(
what should he do? he is a good kid (25 years old) and he confide in me since he cant tell his parents and seems to have been at the wrong place at the wrong time. if he admits it to immigration at the landing intreview will he be refused to canada
 
He's going to need to tell IRCC about it - if he is asked and lies about it, he may likely have his PR revoked due to misrepresentation. Plus, IRCC likely already knows.

They will typically postpone landing until the charges are resolved by either conviction or acquittal.

This really sucks but one question during the interview is "did you have criminal charged or convicted after the AOR"

Yes, I told him he shouldn’t lie and he just wants a chance to clear this from his record and get his papers. Thank you for the reply I appreciate it.

Even he had a PR already, any mid-serious crime is enough to revoke his PR

Citizen is better

Misrepresentation is 5 years ban even visiting the country, not to mention the future PR application or work permit.

Tell him to invest in a good lawyer, if he was really just a bystander (I won't say innocent but let's say unwitting) in whatever happened, a good lawyer will be able to prove he wasn't a dealer.

He needs legal advice, so maybe they can drop the charges or he can get a plea deal for a misdemeanor before he lands.

But he'll have to disclose it to them, he doesn't have a choice. Remember there is no statute of limitations when it comes to misrepresentation, at any time they can revoke his PR if he hasn't been truthful. Better to tell them he got acquitted or was charged with a misdemeanor than to say the charges are still pending when he needs to land.

Tell him to stay away from this foolishness in the future.
 
Thank you guys. Makes a lot of sense and he is being referred to a top lawyer in Ottawa so hopefully he can overcome those charge and will not affect him too much
