urgent : denied entry to the United States to give Biometrics

Hi,

I heard a lot of PR and WP applicants lately getting refused to enter the USA at the borders when they mention that they have the intention to give the biometrics (fingerprints) inside the U.S

Is this an issue with land borders officers only ? what about entering the U.S by an airport ?

I have the intention to give my fingerprints in St Albans - Vermont, so I will really appreciate sharing your experience as I'm very worried about this

This happens because you're only supposed to be giving biometrics in the US if you are in the country for other reasons.

IRCC's website states "You must already be legally in the U.S. to go to an ASC"

of course, I won't be traveling all the way to U.S without a valid visa for sure
what I was trying to say is that the reason that many PR applicants / U.S visa holders living in Canada were denied entry to the U.S for, basing on many threads I read on this forum, was giving biometrics inside the U.S

That's right, because you must already be legally in the United States to give biometrics there.

Since you are in Canada and travelling to the US, you are not already legally in the United States.

The site doesn't say "must be able to legally travel to the US," it says that you must legally already be in the US.

Some have been refused but many have entered the US without issue to give their biometrics. All you can do is try.

I think the only way to get through this is to just be honest with the visa officer the day when they will ask me about the purpose of my visit and the same again with the U.S border services officer.

Why would you ever tell them you're traveling to give biometrics? Vermont is beautiful in the fall, so you have a valid tourist reason to enter that nobody is going to question. Entering to give biometrics is just not on the list of the common tourist activities (I assume you're entering on a tourist visa), although nothing prohibits you from doing this once you're already in the US.

To to k.h.p. point that you need to be in the country legally - by the moment you give biometrics you need to show USCIS your status documents, including your visa and I-94. Technically you should be allowed to give biometrics even in the visitor status.

Yes, but since the US government has said you just already be in the country legally, CBP officers are denying admission to people whose purpose is biometrics.

As you said, be a tourist. Happen to go to the biometrics office while you are being a tourist.
