hi everyone just need some help. I have been in my noc b job straight after getting my pgwp. The job was advertised in November and I accepted in December and started on Jan 21 of this year. My employers and myself were discussing Lima , does the job need to be advertised in job bank Canada ? And can I get a positive lmia if I’m already in the job and how long

Your employer needs to advertise the job again if they want to apply for an LMIA. They need to review the LMIA advertising requirements and follow them specifically. Yes - they need to advertise in job bank and also in two other places that meet the LMIA requirements. If the advertising requirements are not met, the LMIA will be refused.

I have contacted LMIA, and thank you for the information, it is correct. It is very silly because they are advertising a job that is not available however they are no fees for the employers to pay in which at least they may consider doing this.

There is a requirement for your employer to prove no Canadian could be hired for the role. That's why advertising is required immediately before the LMIA application submission. It has nothing to do with whether you are in the role already or not.

i was hired coz they was no other person suitable, that to me makes no sense why LMIA do not support those who are already working and should accept the proof of hiring from before.

Again, all I can tell you is that your employer has to follow the rules and advertise again if you want the LMIA to be approved. I didn't make the rules - just explaining what you need to do to be successful.

Also make sure that you are being paid at least the median wage for your NOC in your region. If you are being paid less than the median wage, the LMIA will be refused.
