You may be eligible for the pilot project if:

  • you’re applying to be sponsored as a spouse, common-law partner, or dependent child
AND

  • your sponsor didn’t declare you when they became a permanent resident
    • as a resettled refugee
    • after being granted refugee protection in Canada
    • as a dependent of a resettled refugee/protected person or
    • after being sponsored as a spouse, common-law partner, conjugal partner, or dependent child

Hi! I also have a question regarding this new rule/program. My husband currently has a PR status, as far as I know, he was sponsored by his mother. His mother was a live-in caregiver then and she applied for PR together with her children (including my husband). They all got their PR status the same time. In the process of their application, I got pregnant and gave birth a year and a half prior their departure for Canada. We weren't married then, he only came back 2 years after they have landed to marry me. My husband's mother did not declare our child on their application and also me, tho we weren't living together at that time. My boyfriend then, landed single with no dependent. My question is, do we have a shot on this? I'm a little confused with the way her mother got them under the live-in caregiver program. Were they (my husband and his siblings) sponsored as a dependent child or were they only added as a dependent child on their mother's PR application? Please enlighten me. Thank you.

Hi,
Good day. inquiry again in regards to undeclared dependent. Based on eligibility, it looks like i am qualified because i was sponsored as a dependent. under further eligibility would anyone know if there is a cut off age? I am a bit confuse in regards to lock in date/age thing . When I received my permanent residence they were under age at that time. My two sons are now over 22. Am I still eligible?

No - you do not have a shot at this. Only those who immigrate through a refugee program or family sponsorship qualify.

Your husband obtained PR through an economic immigration stream - which is why he does not fall under the pilot. He was not sponsored by his mother - but rather he obtained PR along with his mother (as her dependent) through the live-in caregiver economic immigration stream.

There are really two options available to you. The first is that you have to qualify for PR on your own (through an economic immigration stream like Express Entry based on your work experience, level of education, etc.) and include your daughter in the application. The second option is for your husband to renounce his PR status and leave Canada - the all of you would apply for PR together through an economic immigration stream.

Based on the information you have provided - it's not possible to say if you qualify. You'll need to provide more information.

What immigration program did you immigrate under? You have said that you were a dependent in an application. Which immigration program did the primary applicant apply under?

No, you are not eligible. They are far too old.
