Hey Everyone!
Any help on this will be great.
1) My partner and I have decided to get married and would like to move to Canada in September of 2019. If we apply inland for spousal sponsorship are either or both of us allowed to leave Canada during this time? To go to a other country other than the US?
2) would it be better for us to marry in Canada and apply for an extension to his 6 month allowance in canada along with the spousal sponsorship application?

Any help would be great!

I am a Canadian citizen. I came as a visitor to the usa for 3 months. He is an american citizen.
You can sponsor Inland or Outland. Outland is best if you want to stay outside canada for the sponsorship process. If you are sponsoring Inland (re: your plans of moving here in September), they generally allow 2-3 weeks for a trip outside the country, but re-entry will always be risky if you leave for longer and they could deny your husband entry and the application will be considered abandoned.

I think inland is out best bet. I won't be able to return to the USA after November of this year otherwise I will have over stayed. Will he be able to be in Canada for the duration of the application?

If he has visitor status, yes. He will most likely have to extend before the first 6 months are up (unless you also apply for an OWP, which will grant him implied status - unless it is returned for any reason).

If we marry before we move to Canada do you feel like that helps our case or hinders it? Also, do you know the likelihood of him being granted extension after the six months if we dont apply for OWP? Sorry I know some of this may seem simple, but navigating everything has been difficult. Your help is so greatly appreciated!

I don't know whether getting married in Canada vs US would make a difference, maybe senior members can chime in.

There is always a chance of being denied the extension, of course, but if you mention that you are in process of spousal sponsorship they usually don't have a problem extending, from what I've seen.

You should apply for the OWP in any case, the permit takes 3-4 months to process and you don't have to worry about his status as long as the application is complete, AND he will be able to work while you both wait for the PR application to finish up. If you do go this route, make sure you send the OWP with the PR app while he is in status, otherwise the OWP will be issued a lot later (closer to 10th month).
