Hello everyone,

Here is the situation, I am living in Canada as a temporary worker and I just submitted a profile a few days ago and I have 466 points (kinda confident that I will get and ITA tomorrow). My spouse is currently waiting a response for a tourist visa (we were planning w trip in the summer). My questions are :

1- Since my WP expires on Aug 2nd 2019, when exactly should I apply for a BOWP? let's consider I receive an ITA by tomorrow, should I do it after I submit my papers online?

2- Also, am I able to include my spouse in the BOWP application ? (knowing that she is outland and she is dependent in my EE profile). or will she have to apply independently?

As you are within 4 months of the expiry of your current work permit, you could submit the BOWP application as soon as you receive your email AOR (acknowledgement of receipt). You must include a copy of the AOR with your BOWP application.

Your wife would need to submit her own work permit application. Only the Principal Applicant (PA) is eligible for a BOWP, however your spouse may be eligible for spouse open work permit, based on your BOWP. You can submit the two applications at the same time. Both should include a copy of the AOR. Assuming you are applying under the CEC class, your spouse would not require proof of your employment. See the bottom of the page at this link, "Spouse or common-law partner and dependents"

I came to Canada as student then I got PGwP. My wife came later as a part time student and completed her studies.

I applied for CEC PR and it is processing. During my PR application, my wife applied for a PGWP which was refused since her studies were part-time.

Now, both me and my wife are applying for a BOWP. My question is, can my wife work till we get a decision on our BOWP?

N.B. She is currently on a study permit and she finished her studies

No she cannot without a permit.

Because she is not authorized to work. She did not have a work permit before applying for a new permit, therefore no implied status when she applied for her SOWP.

(BTW, only the principal applicant is eligible for a BOWP. She would be eligible for a spouse's open work permit if your BOWP is approved. You can apply at the same time).

Did they provide or did you manage to know what was the reason behind the rejection ?

Of course they did. They said that my CURRENT work permit is due to expire within 6 months which I found very confusing because I mentioned in the letter that it's due to expire on august and I HAVE ALREADY applied for a BOWP and of course provided all evidences. but still they rejected it. this is the second rejection for my spouse and we decided to just wait for the PR to be reunited

Hey, I have part time studies and applied for PGWP (so I might get refused) and my husband will be applying for CEC PR. Did your wife get the BOWP and PR? It will really help to know as I am worried if my PGWP refusal will negatively impact PR application....
