My fiance is the PR and he wants to sponsor me as common-law. We lived together for 2 years when he went back to our country. The situation is:

He was sponsored by his Mom as a dependent child so apparently, I wasn't declared as his common-law during the application and when he landed.

I saw the cit0458e form for the statutory declaration of common-law union. Do we submit it first before the application or we'll submit it together with the application?

----

Thanks in advance.

He actually didn't;t qualify to be sponsored by his mother if he was common law and committed misrepresentation.

You can never be sponsored by your fiance.

Why not? He's been sponsored as dependent child last Sept 2016.

Based on your first post, you were common law before he came to Canada and became a PR. Is that correct?

After he went back to our country. The timeline was:

Sept 2016 - Feb 2017 = he stayed in Canada

Feb 2017 - Feb 2019 = he stayed in our country (PH). That's the time we lived together.

Did he then return home and live with you for 2 years?

Yes, he only stayed 5 mos in canada when he landed. But just this year he went back to continue his PR status. So we were able to lived together for 2 years when he was here.

So he can sponsor you but you will have to prove that you were not living together before.

Sure we can. But what should we do first for him to sponsor me as common-law? Should we submit first the statutory declaration before we proceed with the application?

What other proof do you have that you have been living together all that time?

We have the contract of lease, bills, bank statement for remittances, mails that proves we lived in the same address, IDs showing the same address and probably we will get an affidavit from the people who knows we lived together (ie. village guard, caretaker and friends)

That would be sufficient, don't forget the 20 pictures;) taken together in the PH's during the time you were together;)

Oh, about the pictures. We only have few pictures taken together with our family. I think we only have 8 of them and the rest are taken in our apartment. Will that be okay? The checklist stated different place and time.

2 years together and you were only able to take 8 pictures outside your apartment? I'm not sure how this is going to fly with the immigration officer... maybe someone else could answer this?

and we all know that Filipino's love taking pictures;) You should have well over 1000 pictures if you are a Filipino and have been living together for so long.
