My student visa had expired on 31 May, 2012 and I left Canada on 8 Sept, 2012. My spouse and I are applying for EE now. She is the PA. Will my overstaying affect the process? Should my spouse mention this info in LoE?
 
You should be completely honest on your Express Entry profile. Because if you lie or do not disclose that information, they will find it on their own and ban you for 5 years for misrepresentation.

Few points to keep in mind:
1. DO NOT KEEP YOUR OVERSTAY HIDDEN, MENTION IT UNDER YOUR PERSONAL HISTORY, NOT "WORK HISTORY". Disclose it, else they will ban you for lying and misrepresentation. I know it's in CAPS, but because they need to be in CAPS becuase of the importance.
2. They might ask you why you had overstayed, for which you should come up with a reason that can be explained via documentary evidence such as illness, accident, girlfriend at that time got pregnant, my parents would had forced marriage upon my return (last two pun intended :P)
3. If you have a qualifying work experience which was obtained while staying illegally, omit that, because experience accumulated while staying illegally is not valid experience, if you choose to use you could either be disqualified and have to reapply again or may get banned for misrepresentation.
 
Thank you. This helps a lot. The real reason is that I was scammed by one of my flatmates for 6000 dollars and out of fear I didn't tell my family back home. I just didn't have the money to buy a flight ticket. I was not working anywhere and was surviving off of popcorn and bread for a couple of months until it got too much for me and I came clean to my dad. He was super pissed but booked a flight for me. But I don't have any documentary evidence of all this except the flight ticket in my email.

6000 FRIGGIN DOLLARS, 3 LAKH RUPEES, WHOAA! That's a lot of money! What scam did he pull on you? I would totally understand if you do not feel comfortable in telling it, I am just curious.

There's a chance that they might not ask you and let it pass because one, I believe you don't have a criminal history and second you are being honest on your application. If they ask, you could tell them the same story, though I have no clue if they will buy it or not.
 
Yea, not really comfortable sharing it online. I will mention in LoE about the overstay due to financial difficulties. In case they ask for more info, I'll explain in details. Thanks for your help!
