Hi guys,

If I get a job offer that is not in the same city as my sponsor lives in, can I move there alone without affecting my sponsorship application? It is very hard for me to find a stable job relating to my profession where we live so I am searching jobs that require me to relocate.

Please advise.

As long as you have established common law then it is acceptable to live apart for a reason such as the one you've listed... Only once than 12 month consecutive period of a marriage like relationships with no significant breaks has been established.

"According to case law, the definition of a common-law partner should be read as “an individual who is (ordinarily) cohabiting.” After the one year period of cohabitation has been established, the partners may live apart for periods of time while still maintaining a common-law relationship. For example, a couple may have been separated due to illness or death of a family member, adverse country conditions (e.g. war, political unrest), or employment or education-related reasons"

Thank you for your reply.

We have submitted our application and are waiting for an OWP.

Do I have to notify CIC that we will not be able to live together due to our jobs?

For inland, you have to live together. So unfortunately this won't work out.

As scylla just pointed out, if you applied inland you cannot do this, oversight on my part for not asking what stream you applied for. What I said still stands if you had applied outland and were on a different type of work permit, but applying inland means you have to live together.

You have to live together if you applied inland. Even if you're married and not common law and you applied inland you still have to live together, not apart
