Pr card- out of date

Hi everyone

I was in Canada in years between 2006-2010 and I had a pr card back then.
I was 17 when I came back to my hometown in 2010.
I did not apply for renewing the pr-card and I also did not get a cancellation. I haven't been in Canada since 2010.
I am 26 years old right now and my mom has been in Canada since 2007. She got her citizenship 2 years ago. I graduated from college recently.

My question is what should I do to get my status again? My situation is unclear and I am not sure what steps I should follow.

You are no longer a PR of Canada. You did not meet the residency obligation. You would need to re-apply for PR through an economic stream if you qualify.

It was not my choice to stay in back home I was 17 and my father decided me to stay. So is there anyhthing I can do about this matter or do I need to apply for a pr card all over again ?

You're not applying for a PR Card. You are no longer a PR. You would need to go through the process of applying for permanent residency all over again if you can independently qualify through an economic stream. It doesn't matter that it wasn't your choice.

Not unless she has no other living family she could sponsor instead, since you're past the age of being a dependent.

she doesn't have any relatives blood tight there. She only has a Canadian husband.

Your PR status is still valid just not your PR card. The only way to enter would be to apply for a PRTD on H& C grounds or to try and enter via the US border without getting reported. Your mother can not sponsor you.

It is kind of complicated to enter America first. It is hard for me to get American visa from where I am.
You are saying that my pr status is still valid so is there anything else I can do to renew it?

You're no longer a PR. You have to be in Canada for 2 years every 5 year period. And since you havent been to Canada for the past 9 years you did NOT meet the obligations meaning you are not a PR. And need to apply again on your own.

This is not completely accurate. PR status stays valid till it is either revoked or renounced. It does not simply expire.

That being said, you are correct in that the OP hasn't maintained his Residency Obligations, and therefore when he attempts to enter Canada from the US (or applies for a PRTD), CBSA will almost certainly begin the process of revoking his PR.

OP - the only way to keep your PR status is to apply for a PRTD/enter Canada from the US. Then, when the officer writes the report that will revoke your PR, you have one month (or 60 days if it's the PRTD) to appeal that decision. If your appeal is successful, you will keep your status.

There is a very (very!) small chance where the CBSA officer at the border (if you travel from the US) is satisfied with an explanation and lets you into Canada without writing the report. If this happens, you will have to stay in Canada for two years to remain in compliance with your RO. This is highly unlikely to happen in your case since you've been away too long.

Your most realistic option is to win the appeal. If you lose, you will need to apply for PR like any other foreign national.

Chance of OP getting the PRTD and/or appeal is not very high. He is already 26 and would have been able to return to Canada years ago when he became an adult. (Can't claim removed by parents after he's the ability to come back years ago)

No. She cannot sponsor you. And if your mother's parents or grandparents are alive, she cannot sponsor you either.

My husband went through this exact situation in 2015. His father pretty much made him leave Canada to do university His pr expired and he was still out of Canada so he didn't renew it. In 2015 we attempted to renew it because it would have been faster and cheaper than the sponsorship. The application was denied because he didn't meet the residency obligations. We appealed and still lost even though he explained it wasn't his choice to leave. He also was following the request of his father. Unfortunately, this doesn't matter. You will have to try and reapply. Sorry

You may have been 17 when you left, but at age 18 you are an adult and could have come back to Canada then. Or any time between 2010 and now. You have been out of the country for nearly 10 years. What prevented you from coming back between age 18 and now?
