Sponsorship US husband +2 kids with me in Canada.

Hello and thank you all for your time in this..

I'm a PR card holder hoping to reunite my family.
I'm about to tackle my application to sponsor my US citizen husband and my 2 girls, also US citizen. Husband is currently in US working but the girls (aged 2 yrs old and 8 months old) are here with me in Canada. I moved back here last year to be closer to my extended family.

I thought outland, family class was my way to process this. But now I'm thinking if the fact that my girls are with me here would create problems. How do they do their medical from here? How do I address them on the forms as they wouldn't be from outland like my husband?

I know also to extend their 6 month stay 30 days before their 6 months here expires (thanks to these forums).

You can process them outland even if they are in Canada. They can do medicals here.

Question: are you in compliance with your residence obligation? Meaning have you PHYSICALLY lived in Canada for 730 days out of the last 5 years (April 2, 2014 to now)???

Edit: Backtracked and saw you are not in compliance. I hope you take the advice given to you and not start a sponsorship until November 2020. You will trigger a breach of RO investigation and put your own PR status at risk if you sponsor your husband and children now.

I've contacted a commissioner of oath and explained my situation. At best, he responded with, go submit the application and see what they say and see what they require. He explained Canada does care about family being reunited. But I know it's a gamble.

I'm thinking to reach out to immigration lawyers to see if they say any different. I know the sure fire safest thing is to sit on these papers until the day I reach 730 days.

I do wish time was something I could sit on, but I'm just wishing my husband could be with us as soon as possible.

MPs cannot influence immigration decisions. I hope you are aware of that. A commissioner of oath, you mean a lawyer or paralegal?, have even less power.

Seeing as you have been living here less than a year, you also do not have H&C grounds that I can see. As a green card holder, reunification of your family can be done in the USA and does not have to be in Canada. Your extended family members will not be a point of consideration if you want to pull the “I need my husband with me” card. But, as always, all we do here is advise and wish people luck.

Follow up question, dear jddd..

Will there be an issue when I sponsor if I continue to have my young children living here with me until I meet RO? I would only need to continue extending their visitor visa (US passport) until then, correct?
