Hi I am a student studying in Manitoba and I’m applying for my PR through common law sponsorship. I am working while in school and I’m just wondering what do I send in with my application? A pay stub or a bank statement? Do they need to see the hours I’ve worked or just that I do receive money from my work place. Because I’ve worked over 20 hours. Is that going to be a problem for the application?

So YOU are the person who wants to be sponsored (i.e. NOT a Canadian) - aka 'Principal Applicant'?

If so, then it is your common law partner who is the Sponsor. They have to prove he / she can support you / is not on social assistance etc, not you.

Yes but my partner does not work, but receives funding while she attends school, and so wouldn’t I have to prove that we are financially stable? Through our bank statements

You do realize that by working more than 20 hours a week, you are working illegally...

You can provide proof of your savings, any student loans/grants/scholarships she has, both your savings accounts, any family support, your plans to get jobs if you are graduating soon. All these things will add up t show you can support yourselves. Base on your situation include what is relevant.

okay yeah I don't think getting any of that will be a problem. The only problem now is whether there is someway they can find out how many hours I 'was' working. which was over 20 at one point. is there anyways during the application process that they can find that out?

How long did you work over 20 hours? Did you work significantly more than 20 hours? You can work 20+ hours during scheduled breaks from school like holidays and summers (if applicable) as long as you were a full-time student. If your income looks too high for 20 hours per week yes. they can figure out you worked one 20 hours. In general it is best to apologize and say you didn't know and ask for forgiveness. The 20 hours/week is pretty basic knowledge so not sure how you didn't know.

When i came to canada I was told I was able to work off campus, and that was it. My employer knows im a student and never said anything and ive filed tax returns and no one has said anything, until a little while ago when i found out from someone and it came up in conversation. I have since stopped working over 20 hours. And I was working like 30 hours a week for a while.

If I dont apply or an OWP with PR, will they still find out? or there might be hope that they wont?

i make like $1000 a month. does that look like too much? im not sure what is too much

I'm not a lawyer so don't feel like I can give advice about this. In general Canada is more forgiving if you admit your error and apologize than if they figure it out themselves. @scylla @canuck_in_uk ?

I know. thanks for your replies though. Just curious, would you happen to know how would i go about apologizing? who do I apologize to and how?

You don't apologize. You declare if asked. I cannot recall the PR app asking about illegal work but the OWP app does.

Also note that if you apply for the OWP, you must stop studying once it is approved.
