Visitors from visa-exempt country re-entering Canada

Hello guys,

I am getting prepared to face the worst case scenario if my visitor record extension got refused.
(If I got the extension, then everything would work.)

I am from a visa-exempt country and is currently in Canada. I am now waiting for the result of the visa extension and also trying to get the 12 months of cohabitation with my partner. If my visa was refused, we would go for a trip for about a week (he only has a maximum of 7 days break).

I am wondering if I could come back with eTA within a week or two after leaving Canada. Will they let me in if I say my boyfriend is going to apply for a sponsorship? Because we would still have 3 months to meet the eligibility to apply for a sponsorship if I got rejected in December, I want to continue staying with him.

Easier said than done, but I suggest to worry about this scenario later. Why do you expect your extension application to be rejected? If you did everything right and you have a good case, no reason to worry.

This would be the third extension if it was approved.

However, I left Canada due to the family obligation in February before my last permit expired. When I returned in March, the custom officer said I could only stay until the date that was given, which is in April. So I applied for the extension again to ensure that I could take my exam in May. The result of this extension came out very fast, in about five weeks.

I applied for another one, which I am still waiting, to cover the exam in the end of October. I assume that the result would come out in the end of December or in the beginning of January. Because this would be the third time, I am very worried. I then want to make sure that at least I will not plan a trip from scratch or have no idea what to do for my sponsorship part when the visa is refused.

Okay. Well that was a lot of essential information you left out from your original post. This also factors in to your original question.

Did you cite sponsorship as a reason for your extension? I’m no expert on this matter TBH, but from what I’ve seen on this forum and others have advised, it’s an acceptable reason provided you show you have the funds to cover your stay.

It makes things easier now. I did not make a note saying that I would be sponsored because the original purpose was for attending the exam. We started to discuss the sponsorship after finishing all the important exams since I realized that I could not get a higher score on IELTS for boosting EE score in a short time (have tried 1 IELTS and 3 CELPIP).

To clarify what you said, did you mean that I can come back after the trip (if needed) and tell the officer that I will be sponsored?

I found some people's stories on the forum. These showed me the possibility of getting visa extension with the reason of sponsorship application. But, my problem is still there...if my visa got approved, I would have no trouble cohabiting continuously for 12 months.

Can I talk about the sponsorship if I apply for restoration? If it was needed, I could apply for the sponsorship and restoration almost at the same time. Is it better than going on a trip and coming back in a short period of time?

You can apply if you are out-of-status. You don't get implied status from a PR application and you run the risk of being asked to leave.

If you are out-of-status, you cannot apply for the OWP, so it's at least 12 months you will not be working.

I would recommend that you do not overstay your visa to establish common-law relationship status.

Did you mean it's better not to apply for restoration?
I was thinking to apply for restoration as a visitor and mention that my partner and I are establishing our common-law status and will apply for sponsorship soon. After getting my extended visa, we would be able to apply for sponsorship and OWP.
