hi everyone so of course I know getting married you can sponsor your spouse.
My gf and I are deeply in love I've never met anyone in my life that completes me like her. She feels the same for me.
Long story short is she's already been sponsored by her husband, but they aren't living together. We've been living together for almost a year now, however her PR application is still in with the husband because the lawyer(which I don't like) said it's best to keep it in still.......
She's already had an interview for 2hrs with her husband....n is awaiting an email or mail to return in the next 4weeks to get an answer. We spoke to another lawyer and she said if they call you in for a 2nd interview not to go in because they detain you on the second interview. She said she could get a divorce and submit a new marriage application with me because it is the real thing we have lots of evidencial proof of a real committed relationship. What would happen could I sponsor my love? Also she is pregnant with my child. Please help.
 
First of all she needs to stop the sponsorship by her husband. if they are not together anymore. If she goes ahead with it, and if the CIC find out it is fraudulent, her and her husband could possibly be banned from entering Canada for 5 years due to misrepresentation. The lawyer that is doing their case should know this.

Is she being sponsored by her husband for PR to Canada? If so, she needs to cancel / withdraw this application immediately. She is no longer with her husband and moving forward with this application is misrepresentation (i.e. lying). Lying is taken extremely seriously by IRCC. If they figure out that she is lying before she tells them the relationship with her husband is over, IRCC will make a misrepresentation finding and ban her from Canada for five years. Before she does anything else, she needs to cancel the existing application before IRCC figures out she is lying. This is extremely important. She clearly must have lied in the interview with her husband - that's not good - in fact it's very bad for her future in Canada. She needs to stop lying and withdraw the current application before she's banned from Canada for five years.

How long does a withdrawal take? And they've already gone into the interview together. Would that effect the withdrawal?

Withdrawal can take a few weeks or couple of months. She needs to contact IRCC asap (TODAY) to start this process.

To be brutally honest, the two of you are playing with fire and placing your future in Canada in massive jeopardy. She has made extremely poor choices by proceeding with the application fraudulently when she is no longer in a relationship with her husband - and further committing fraud through attending the interview with her husband and lying in the interview.

The fact she has done this is going to make it much more difficult for you to sponsor her.

Once again, she needs to withdraw the current application ASAP.

Again this was poor lawyer representation, so because she's been in an interview already and is now awaiting a response, withdrawing the application, how will that affect her? I just want to do things right and get out of this mess. Without punishment.

And even if the current PR application is approved, because she obtained her PR status through fraud - her status in Canada will never be safe and may be revoked at any time in the future (even once she is a citizen).

IRCC will hold your girlfriend responsible for all decisions made regarding her application. Doesn't matter if she received assistance from a lawyer. She is held responsible as the applicant. Suggest she drop her lawyer immediately and find a new one.

I understand, but still doesn't answer my question that if she withdraws the application and has been in the interview already will they question her as why she withdrew right after an interview?
I don't know who to trust anymore like I feel lawyers just lead u in a path so they can make money
 
Here's what I would do in your situation.

(1) Withdraw the current application with a simple note that the relationship has fallen apart and that the applicant and sponsor are going to be divorcing.
(2) If at all possible, have your girlfriend apply for PR on her own through an economic stream like Express Entry.
(3) If the above is not possible, wait a year before you apply to sponsor her for PR.

The fact the two of you have been living together for a year already is extremely problematic. If you apply to sponsor her immediately after the current application is withdrawn, IRCC is going to have problems with that application given the timing of the withdrawal of the current application and the statements she has made in the interview.

The "right" thing to do would have been to cancel the current application a year ago when you first started living together and her relationship with her husband fell apart. Because she failed to do that, you now have an absolutely massive mess on your hands. Expect complications because she has committed fraud. Sorry for the frank messaging. You need to understand how serious this situation is.
