Just a heads up. My MP said there is over a 2 1/2 week backlog for for them to get information, normally it's a 2 day response. This backlog started mid August. Even their own phone line to Ottawa is a 45 minute wait and that shocked my MP.
Let's just stay strong and keep patience.

FYI....I was also told, the more you get your MP to check on your file, it actually slows down the processing time and takes longer, cause they have to stop and answer MP's and then get back to continue processing.

Wow I think so too we cleared all the concerns , and they did believe our marriage was real just ministery councilar kept pointing my past..
what were their concerns about your past? we have our full hearing Nov 28

i brought evidence but they didnt take it. when you go all they do is tell you about submitting evidence and making copies. Then taking you to get your date. its 30 mins top. waste of time if you ask me.
They didn't have to make you come back just for that. *eye roll*

Hey,

I've been scheduled for a mediation in october. Is that the same as an ADR everyone is referring to in the thread? I still haven't reveived an official letter but the women assigned to my case called me and gave me this info saying that it's a mediation.
I see a lot saying that after the ADR they had to go for a full hearing. However the women from the appeals division told me that if i win the mediation i do not have to go for a full hearing and they just reopen my file. Is it only for people who fail their mediation who go to full hearing? Thanks.

And if anyone can share what they were asked during the mediation i would appreciate it. My case was refused claiming that our marriage is not genuine, i went back and visited and got more evidence.

That is true.... the journey isn't easy but it will come to an end eventually. Just be patient and pray more. What helped me most was singing so just look for something that will keep your mind off.

I clean a lot and play music. What else do I have to do? Lol
Also email from MP....IAD hasnt sent letter to Ottawa. Maybe it's getting walked across the country. Lol
Anyways time will tell.

Yes, we have more waiting to do as the police certificate took a long time to obtain and was only submitted on Friday. They can ask any questions they want, not necessarily only the ones that are related to the denial. I only had one question that was remotely related to the denial, my denial reasons were STUPID and I this even the immigration officer realized that. But he did go through all the relationship from beginning to end, how we met, how the relationship developed, whether our parents are involved and how they reacted to the relationship, what our plans for the future are! My ADR was short, 25 minutes, but I also had a ton of evidence!
Our ADR was also short. Its about 14 to 30 minutes. Reason was same not genuine. We send everything in the shape of three appeal books. When we send our first book with a great quality proof. My wife received call from IAD and they appreciate our effort. After that we send two more books and explain all the refusal concern. Visa officer was mostly asking general questions and Minister council only asked three questions from my wife and that were about her children why she told them late, Why not before, Is her parent know about our relationship.
Our ADR was on 19 July 2018 and we are still waiting for the decision. At the end of the interview CIC officer told to my wife that she has concern about background even after sending all every proof. Her statement make my wife angry and she told them, Still you have concern when i give you everything we have, Minister council told her that we never mean that these books are nothing. She told her we will review all the proof and give you decision. Still we are waiting for our decision.
We are very positive as our proof was very comprehensive.

Our ADR was on 19 July 2018. We send overall three appeal books. We send our all proof since from day 1 when our relationship started 29 December 2014 to till 30 June 2018. Cover all the concern of the officer.
We send letter from my parent, my friends and cousin, my wife friend, financial support, photos, conversation from 2015 to June 2018 and Call history was separated from the last 2 and half years separated, Mobile bills which i paid in Dubai AED 770 ALMOST 272 Canadian Dollar,, Photos of our different occasion from the last three trip, letter from religious scholar to clear about age issue in Islam,
Many other proof. They never give us decision at that time but still we are waiting. We are positive as we claim that we are genuine couples and we send all the proof which i just mention upper.
What you guys think about our proof. Even my wife received a call from IAD and they appreciate us the way we present our books.

HI Guys, I need your inputs from you experiences please !!!

I filed my spouse sponsorship application on Nov 2017.

- We are in relationship from last 5 years. I vested her every year to India. Provided them last 3 trips of my tickets & boarding pass for my last visit.

- I proposed her in 2016, and we exchanged rings & last that night both our families went out for dinner (We provided them pictures).

- In 2017 we got married. We did it in a simple way. It was a one day function. We followed my father’s rituals & exchanged vows in from of Pantidji and 150 relatives and guest. All guest came on stage & greeted you & gave us gifts/covers. Later, girl’s side did a dance performance. Ad followed by dinner. (We provided them pictures). BUT we didn’t do Saptapadi ceremony, as that’s not my father did it at his time and so my grandfather.

- We registered our marriage in Gujarat government office & got a marriage certificate.

- LAST week, she got a call from New Delhi asking about marriage ceremonies (pre wedding, post-wedding, and wedding). She explained them that it was done in a simple way. “But still officer was saying as per the rituals, you should have done some ceremonies, right? Can you send us pictures with date & time?”

- We sent the all description how all ceremonies were performed, Along with Mehndi ceremony pics, spouse cousin’s Dance performance pics, Wedding ceremony (As per our rituals) pics, and post-wedding ceremony- “Welcoming The bride” pics.

Now my concern is,

1) Is it a Red Flag?
2) Will my marriage be considered a valid marriage under Hindu Marriage ACT without Saptapadi?
3) Are they going to refuse our application based on Hindu Marriage ACT/ Marriage genuine?
4) Is this something can be won via appeal?

Note that, she has changed her last name & added mine in her Indian passport, driver’s license, Aadhar Car (National Identity), PAN card, Bank everywhere..

Any help/insight are most welcome. And thank you in advance.

When a judge assess your case in the full hearing, they used something call the balance of probabilities, this has nothing to do with legal argument, it is more like their perception is used. For example, I have seen cases that are very similar, both appellants were caught somewhat related to MOC in their past, they both submitted similar evidence, however one appeal was allowed while the other one was not, due to the fact that one appellant has a job and house, but the other has no stable job or hard asset in Canada. This is why they always say every case is unique, even though their circumstances are similar.

If you are rejected because of Subsection 4(1) Bad faith; what you need is someone who can help you to come up with better convincing evidence not better legal argument. In order to win the appeal, you need to pass the 2 pong test, 1. No immigration motive to gain advantage, 2 marriage is genuine.
