Implied Status query

I am in mid of filling out physical presence calculator form, in that form they ask us to "List time with Canadian temporary resident or protected person status"

I have a question about my below situation...

My work permit got expired 31st May 2013 but as work permit extension was already applied before 31st May 2013, I was eligible to work legally under implied status. However my work permit extension got rejected on Aug 14 , 2013 as Labour Market Opinion had not been received and the same day I left my job.

So in physical presence calculator form should I enter Type : Temporary Worker until 31st May 13 or 14th Aug 2013?

I would go with Aug 14th since that was when your application was rejected and you actually quit work. If you put March 31 and then your job says you were there until Aug, that could be seen as intentional misrepresentation.

Thanks for your reply, on the same line I am now filling out citizenship application form and in that they ask Date your status expired should that be 14th Aug 2013 as well. I am getting confused because my work permit actually got expired on 31st May 13.

Yes. I would also list Aug 2013. I would include a short letter describing why you chose those dates for expiration as opposed to your physical work permit which had a different expiry date. That will help them to understand what you did and why.

Hi, I have similar situation.
My work permit extension got rejected too, then I submitted a new work permit application within 90 days and was on restoration period. I remained in Canada until I got my new work permit.
Does these restoration period count in physical presence days in Canada?

I think it's No since officially you didn't have status on behalf of IRCC. I think it's the same as asylum seeker. Days between demand and response are not counted. Prudently I won't take into account those days except with an equivalent buffer. On this forum one member was disqualified because the IRCC officer didn't count the implied status days.

Below link points out restoration period is considered as lost status(search for 'Continue to work or study') , so perhaps that wont be counted.

I will wait more months to be on the safe side.
