Facts
  • I am single right now. Applied to OINP. AOR awaited.
  • There is a probability of me getting married after I receive ITA, probably when my background check is in progress.
  • The probability is also that I might get married after passport stamping or rather after getting PR card.

Questions
1. Does my spouse need to appear for IELTS if I am married after receiving IRCC AOR?
2. Does my spouse need the ECA done for her education (if I am married after receiving IRCC AOR)?
3. What is the effect on timeline if I am married after receiving AOR?
4. If point 1 is true, does my spouse's under performance affect my CRS points and therefore my whole PR application?
5. If my spouse fails medical tests or background check will it affect just her PR processing or both mine and her?

Other Point
I won't ask question regarding PCC for my spouse because I'm sure it is required.

If you get married before the AOR, it's clear: your points will be recalculated once you apply and your marriage will change the score. After AOR, it is challenging to answer. I don't know.

Your score won't be recalculated and your spouse will be added to the current application. If successful, both of you will get PR status together. This can be done even after passport stamping but not after you 'land' in Canada.

You'll get your PR card after you 'land' in Canada. If you get married after you 'land' in Canada, your spouse won't be added to your PR application as that file would be successfully closed. You'll have to get them over under spousal sponsorship route. That takes much longer than EE.

Makes no difference to your PR application but will come in handy if they want to be employed in Canada.

It might delay things by 4-8 weeks while IRCC processes your spouse's documents (marriage certificate, medicals, PCC(s), additional POF) in addition to your documentation.

No.

5. If my spouse fails medical tests or background check will it affect just her PR processing or both mine and her?

Both. It's actually a single application comprising of 2 individuals.

Other Point
I won't ask question regarding PCC for my spouse because I'm sure it is required.

Yes. For all countries they have lived in for 6 months or more since turning 18.

As per Changes to family composition :
Family members can be added to the application at any time during the process, including after the visa is issued, but prior to obtaining permanent resident status. Applicants are instructed to inform CIC immediately if their family composition has changed (e.g., birth of a child, marriage, divorce).

Does this mean that i have time until the landing process( even after the PP has been stamped with the new visa after PPR and the landing process is not yet done ) to change my status to married and include my wife's application with mine so that she also gets the PR along with me ??

But after my passport is stamped with the visa, then i go to India for my marriage and include my wifes application immediately with mine while i am in India only. My wifes visa stamping would take time. Then how do i come back to Canada to report back to my work(Limited Leaves ) ? It will be considered as landing right and my wife would have not got her visa stamped by then to bring her along .

Technically, yes, but you have to realize that when you add a spouse, the application starts at the beginning for them. So it could add 2-6 months (or more) to processing time. If you add a spouse to your application after receiving your COPR (but before landing), you have to return the COPR and wait for a new one.

Yes... and you would have to return the COPR (visa is useless without the COPR).

NO. You cannot land until you both receive your COPR. You can land first, but the COPR must have been issued to all members of the application.

For you to return to Canada at that point and work, you would still need a valid work permit.

One option for people who are planning a wedding is to do the legal marriage as soon as possible so that your spouse's application can be processed concurrently with yours, reducing delays. You can hold the traditional wedding later, as planned.

Thanks Jes_on for all the clarifications .

Once the passport has been stamped with the new visa and COPR has been given, will they not cancel my existing Canada visa and work permit ??
Then how am i supposed to return to work if i change my status from single to married and return the new visa and COPR.

Do i need to apply for BOPW and keep it ready? . My existing work permit expires in Aug 2016.

Can i apply for a BOPW for my wife as well immediately after i include her in my application ??

Please guide me.

Yes I did . Raise CSE IRCC AND LET THEM KNOW ABOUT YOUR MARITAL STATUS. THEY WILL E-MAIL YOU BACK AND INFORM YOU ABOUT THE NEXT STEPS.
ALL THE BEST.

it will take a few months, they have to study her medicals and background check. there are similar cases that got PPR

2- Receipt for Payment of Processing Fee and Right of Permanent Residence for spouse.
3- Generic Application Form IM0008
4- Additional Dependents imm0008depenu form
5- Schedule A Background Declaration form IMM5669 Signed by Spouse
6- Additional Family Information form for Principal Applicant IMM5406e
7- Additional Family Information form for Spouse IMM5406e signed by spouse.
8- Supplementary Information for Travels IMM5562e.
9- Spouse Passport Copy and Birth Certificate.
10- Upfront medical.
11- Police Certificates.
12- Marriage Certificate
13- Proof of relationship (wedding photos, bills, chats ... etc).
14- Spouse digital photo.
