Marital status in India when separated but unable to file divorce

hi

I am looking to submit my profile today. I got married on may 2018 and am separated from my wife since June. Since we did not complete 1 year after marriage, I am not able to file divorce yet. We plan to apply divorce by mutual consent after a year.

May I know what I should state in marital status? Should this be legally separated or should I chose divorced/separated?

Also what are docs I will have to add.

Your help is greatly appreciated.

You are married and not in the process of getting divorced nor are you legally-separated. You mention that you're married and that she is not accompanying, you also explain why. You should be fine.

Should I maintain funds for my wife. Also will the affidavit alone do?

It happens. Mention that you're married and she's not accompanying. You might have to explain more in the LOE than you did here about those personal reasons but still mention that she won't be benefiting from your PR status in the future.

Hopefully you're on good terms with her because you will need her to have her medical exam done and a PCC issued, even if she is not accompanying.

Don’t know how things work in India but @EE456 is rite. U need her PCC and medical. Make her as non accompanying spouse. However, I recently went thru with the same situation. I got married made my EE profile and just after 25 days it turned out that this marriage is bound to end up in divorce. However, I mentioned the funds only for 1 person in my pre ita profile and got invitation because I mentioned non accompanying.

Also, just a piece of advise, try working out your marriage and see if there is anyway u both can settle up things. Divorce can have a emotional impact on u as it had on me.
