I am a Canadian citizen sponsoring my British common law partner. We applied for residency November 2017. We are at the stage where his medical has been received. It is an inland application as he came to Canada on a working holiday visa October 8th, 2016, it will expire October of this year. He sent an open work permit application by mail a few months ago (it has been delivered but we have not been notified that it has been received by cic. Nor can we find it online anywhere) We are worried he has to leave in October because of this, but this will jeopardize residency. Is there any other way he could stay in the country? Could we do a border run so he can come back as a tourist instead of a worker? Anything that may buy us some more time as we feel we are getting very close to residency. Thank you for your time.
 
Others can comment as this is my view only but maybe if the OWP doesn’t come through in time then apply to extend as a visitor. Does mean would need to stop any work though on visitor status.

Most would say not really that advisable to do a border run given always a chance of being denied entry hence the extend option in the 30 days before WHV expires . This could also be denied of course but at least would be on implied status until extension decision made.

People have reported OWPs linked to inland applications on average take 4 months or so by the way.

I hope others chime in soon, but as I understand it he has implied status from having applied for the OWP extension, no? As a spouse being sponsored inland with an application in process, they would be eligible for an OWP (again, I think)

He has implied status to remain in Canada as a visitor but must stop working as soon as the IEC expires. He can start working again once the OWP is approved.

Just curious, but I thought you have to submit for the OWP at the same time you submit the inland application?

We applied for residency November 2017.

I dont think you HAVE to, but the pilot program makes it that you CAN and it's easier to do so :)

Correct. You can either submit it at the same time as you apply for your inland PR at Missisauga or you can mail it to Vegreville at any point after that.

Why did you guys delay in applying for the OWP and not submit it with the PR app? If he applied for the OWP a few months ago, it will probably be approved before his current status expires. If not, he will have Implied Status as a visitor when his IEC permit expires. He will have to stop working while waiting for the OWP.
