Hello guys,

My wife started her Canadian PR process via express entry. With her profile (only) and score, she got an Invitation to Apply and we now have 60 days to submit her application with all the documents. Now, we have a chance of adding myself to her profile and hence submit my application and documents (like PCC and other educational, employment documents) as a secondary applicant. My questions are:

1. Should I just add myself to her application and hence submit my documents as well or give IELTS and submit my application independently? Looking for recommendations. Are there any caveats to submit my application as secondary applicants?

2. If I add myself (as Secondary applicant) and keep my wife as primary applicant, assuming we get our PR approved, will we be treated differently while searching for jobs, or health benefits etc? Or the 'tag' of primary vs secondary applicant becomes irrelevant once we have our physical PR cards in hand?

3. Assuming we (myself and my wife) submit our application on 20th September 2018, and assuming we get our PRs approved with stamped visa on Passport on 20th March 2019 (for example), what would be the cut off date to enter the Canadian land to claim our physical PR cards? Will it be one year from our application submission date (i.e 1 year from 20th Sept 2018), or 1 year from PR approval date (i.e. 1 year from 20th March 2019) or something else?

Thank you for your help in advance.

Did she not include you as dependant or added you as spouse non-accompanied. If she did former then it is a misrepresentation.

While applying initially for EE pool, she said "Yes" to the question of "Will your spouse accompany you?". And now, we have a chance of applying with my documents as secondary applicant.

If you were included as spouse accompanied then where is the issue. Just provide all your documents. Were points claimed for your education and language? If yes then you will need those reports dated pre-ITA. If not and no points being claimed then just submit your PCC, medical along with all documents. What do you mean by primary vs secondary?

Thanks for your reply again. There we no points claimed on my education, language or IELTS score. My wife got her ITA purely based on her qualification. Now that she got an ITA, we have a chance of tagging myself along, and submit my PCC, medical, employment records, education records etc. My wife would be primary applicant (because she got an ITA), and I'll be secondary applicant, because I didnt a ITA independently, and just tagging along with her application.

You were already tagged pre ITA. So nothing additional needs to be done to include you. If no points were claimed then only submit pcc and medical. Don't worry about ielts and eca as it's not mandatory for dependant. You don't even need to include your work history and avoid documentation. Just show in personal history.

Actually, in the list of documents that we need to upload in CIC website, under my section it's asking my enter employment letters, PCC, medical report, education markseets, etc. But, I guess this maybe because we added my work history, my education in the PR Application, where all the details are needed to be filled out.

Can you also help me with question (2) and question (3)?

Thanks,

2. No difference
3. CoPR date is earliest of medical expiry or passport expiry whichever is earliest.

3. You mean expiry date on CoPR (which is also the deadline for entering Canada to claim PR cards) is either the expiry of medical report or expiry of stamped Canadain PR visa on our passports, whichever is earlier?

Thanks.

Not visa but expiry of your passport.

Oh, okay. I thought it's one year from the date when the PR application is submitted (or the day we receive acknowledge of payment receipt and documents). It looks like it is one year from the medical test when we can enter Canada

Nothing to do with PR application submission date. If you got your medical done on 1 July 2018, submitted on 1 Aug 2018 and your passport expires on 1 Jan 2020.
And say your PR application is approved on 31 Dec 2018, then you get you get 6 months to enter Canada.

Okay, understood. Or I guess I can delay my entry to Canada (say enter on 1st October 2018) by giving the medical test again (since my current medical test will expire on 30th June 2019)

No you cannot do that once you get CoPR. if you want to extend you need to write to IRCC and with a very compelling reason, but very unlikely to get an extension. Do a soft landing before CoPr expiry and come back

Okay, understood. Me and my wife are currently in USA and working. Due to a unique visa situation that we are in, I think we may not be able to leave USA before October of 2019. We are thinking of decline this invitation and hope that we get ITA again at a later point. Any other suggestions to counter this? Our 60 day period to submit PR application ends on 25th September 2018.

Thanks.
