Hi,

I am writing for my sister. She applied for visitor visa for spouse twice. Got rejected both times with the reason that he will not come back after his stay. When applied first time - their file of sponsorship came back because of missing document.

Applied second time after sponsorship approval in March - but rejected again.

The question is, now she is buying a business in Canada and want her husband here before she take possession. She will also have a opening ceremony. Do you think it is a valid reason to apply again - I mean is there any point in applying for visitor visa again - or there's no chance of getting visitor visa.

I know no one knows for sure if it will be approved or not - i am just asking for opinion as to if it is a good idea to apply again or not.

The possibility of the visiting spouse to overstay is very high when you have a spousal sponsorship application in-process.......so application for visitor visa chances of approval is very low.......except you able to prove very strong ties to country of residence.

Same ties to home country as shown in previous applications. The only difference this time is that she is buying a business and want her husband to be here for like opening ceremony.

He should not apply again. He's going to be refused again. He already has three refusals and buying a business is an extremely weak reason for having him come to Canada. If anything, this strengthens his ties to Canada which increases the chance of refusal. Also, too many refusals can delay the processing of a spousal sponsorship application and can make CIC concerned the applicant just wants to get to Canada through any means possible and has entered a marriage of convenience. Don't apply again.

With a sponsorship app in process and 2 refusals, there is pretty much zero chance of approval.
