I am here on a visitor visa with my application for residency in the works. I am with my Canadian partner in a legal conman law relationship. We would like to travel back to New Zealand of which I am a citizen in December for a holiday. Will this be allowed?

Have you applied for 'spousal sponsorship'?

If yes, did you apply 'inland' or 'outland' (using the CIC definition)?

If 'outland' then yes, you can travel back no problem.

If 'inland', then of course you will be 'allowed' to leave Canada. Your problem could come when you try to get back in. If you are not allowed back in, your application will be considered 'abandoned' and would be cancelled. The received wisdom is not to leave Canada while an inland sponsorship is in progress, at least not until you have received your Open Work Permit (you do not say if you applied for this at the same time?).

Having said all of this, you may (or may not!) be in with a chance of getting your CoPR etc. by December (I wouldn't rate it higher than 50 / 50 though).
