Husband PR holder- Wife in India

Hi

Can you help me with a situation please?
I am a PR holder in India, got my PR card earlier after short landing in Toronto.

Now, I am going to Canada as need to fulfil condition of 730 days to keep my PR card alive.

My wife is in India too but she doesn't have a PR.
I am planning to sponsor her after I reach Canada.

How much time it takes for this kind of case to process completely? and getting her a PR.

Is there any advice for me while being in India, as I am here for another 2 months, with anything to make this case faster once I land in Canada.

The target for spousal applications is 80% of cases within 12 months of receipt. So that's the timeline you should consider.

Download the checklist http://www.cic.gc.ca/english/information/applications/spouse.asp and forms and start filling them out, and getting the required evidence. That's probably the best advice to get things done as fast as possible.

Do note, that as a sponsor, you will be asked to submit your CRA Notice of Assessment or an Option C form if you are employed in Canada. As you've been outside of Canada for most of the time, you probably will not have these documents. You will have to write a letter explaining why that is the case. If you are not employed in Canada you will have to show a means of support for you and your wife.

You have to clarify your dates. They don't make sense.

Do you mean that you got married in April 2016 or that you got married on April 16, 2017?

Also, if you landed November 2016 - then you PR card validity could not start on January 2016. Do you mean January 2017?

OK - in that case you should plan to return to Canada as soon as you can and then you should have no issues sponsoring your wife for PR once you are in Canada.

Make sure you return to Canada well before November to ensure there are no issues with your residency requirement.

Thanks for the reply.

Yeah, we are exploring all the options and got suggestions also from helping people of this forum.
But, only thing is we don't want to live apart separately for 12 months and even on tourist visa (if we get) as she has her career and need to work there.
Thats why not able to go.
If it would have been 3 - 4 months, would have gone by now.

There's no way for you to make this go any faster, and you likely will be apart from your wife for some time while it is in process. Had you followed up on the advice given to you earlier, you could have potentially been together in Canada already.

The longer you wait, the more you risk not being able to meet your own residency requirement.

So the choice is yours, Be separated for up to year to spend the rest of your lives together in Canada; or remain together in India and risk losing your ability to easily go to Canada.

Your wife could also see if she qualifies independently under Express Entry.

I suppose another option would be to renounce your PR, and then apply again as a couple.

Its not an easy decision to leave your spouse behind when you both are professionals. Might be you will not understand this.
SO, just keep on exploring the least time taking and easiest option.

Earlier, she was not getting IELTS score, so could not go ahead from 2 years.
Now, she got 7 -8 in each module.

So, please understand the situation, rather than just posting anything.

No - she is free to apply under Express Entry.

You also know very little about my situation, but I'll say that I've been living apart from my spouse, partially because of my career, for almost 2 years now with the longest time we've spent together in that time being 3 weeks this past Christmas, so I do know what it's like being separated.

I, too, would like to be together with my husband, and wish for the situation to go a lot faster, but it's not the reality of bureaucracy.

I'm sorry if my post comes across as rude. I hope that you are able to find a solution that works for you.

No - she is free to apply under Express Entry.
ok then probably we will apply under express entry only. That seems to be a better option.

One more thing, our marriage is not registered yet (as in we havent taken the marriage certificate from govt.) and we still have our maiden name in her all the documents.
Can we apply her as single (to avoid hassles of getting the name & address changed from all the documents)?
This process itself will take another 1 or 2 months to get the names changed.

Then we can marry after going there in court or something. What say?
