Is my Lmia fake? Why did canada embassy given me 30 days to respond

hi my agent applied a work permit on behalf of me. I submitted all documents at Vfs Global. After 28 working days, my passport has been dispatched.

Embassy didn’t send me any of my documents but a passport and a letter.

Letter says that

I am not satisfied that you have fulfilled the requirement put upon you by section 16(1) of the immigration and refugee protection act which states

16(1) a person who makes an application must answer truthfully all questions put to them for the purpose of the examination and must produce a visa and all relavent evidence and documents that the officer reasonably requires.

I’m not satisfied that the labous market impact assesment (Lmia) submitted with your application is genuine.

Please note that if it is found that you have engaged in misrepresentation in submitting your application for a work permit you may be found to be inadmissible under section 40(1)(a) of the immigration and refugee protection act.


What does this mean? Is my visa rejected? Emabassy given me 30 days to respond but passport has been dispatched. I applied for a work permit, then Why did embassy mention that it comes under immigration and refugee act? How can i submit additional documents if my passport is dispatched? Is this process fake?

Seems like your agency might have sent in a fake LMIA on your behalf. They are giving you a chance to try and explain that the documentation you submitted wasn't fraudulent before denying your application and likely banning you for a few years.

Agent gave me an offer letter from Stroud Farms, ajax, Ontario. Food and accommodation is free. And also, 3200CAD per month. Work permit Duration is 12 months and is renewable. I didn’t write any ielts and Didn’t submitted any Income Tax returns too. I just submitted my Govt IDs and educational certificates. After 2 months he has given me a file that contains offer letter, LMIA and some other paper work. But why did the Embassy give me 30 days? I got a message to mobile before my passport is dispatched. That is “You are requested to submit additional documents”. And then, Embassy dispatched my passport. If Embassy has kept passport and if i was asked to submit additional documents then it might be ok. But they sent it back without any single document that i submitted. What exactly embassy wanted
To tell me?

They want proof that your LMIA that you've submitted is genuine. This letter is sent to you on the basis that CIC is about to charge you with misrepresentation and that penalty for misrepresentation is 5 years ban from entry into Canada.

You've been scammed obviously.

Then i’ll completely stay away from it.And, I don’t submit any further documents with my passport. What if i just don’t respond? Will it become any issue? I don’t want to be banned so i’ll leave this process. Are there any chances for me to apply again in future or will there be any impact if i leave it now? Will i be allowed to apply any other visa now?

You have to respond back in 30 days. The moment you received that letter, you are being suspected of misrepresentation. If you don't respond back to that letter, you will be banned for 5 years anyway.

You should talk to that agent who provided the LMIA.

For sure sounds like a scam given unlikely that for a farm job no local applicants were available to justify going through with an LMIA to recruit from outside Canada.

You need to sort out your agent assuming they will now even speak to you now.

If you don't respond, the application will be refused and you'll most likely end up with a 5 year misrepresentation ban. Assuming you end up with the ban, it will be 5 years before you can submit any sort of application to Canada.

You have to respond back in 30 days. The moment you received that letter, you are being suspected of misrepresentation. If you don't respond back to that letter, you will be banned for 5 years anyway.

The letter you received asking to respond in 30 days is a procedural fairness letter. You respond to that. It's your opportunity to get them to change their minds.

The letter will tell you where to send all the information to the corresponding officer in charge of your application. You have explain yourself why a fake LMIA was given and attach all emails or documents between you and your agent.

But 90 percent CIC will find fault on the applicant because when you signed your application, you are signing to say that all information given is true. You can always try though.
