We did get news today: application was refused as per GCKey. The official letter is not in the inbox yet, but I think we are in the same box as @HisAma. Our lawyer made a royal mess of our last visitor visa application, we tried to clean it up, but apparently we are still paying for his incompetence.

Ok guys... I just got PPR!!!! but I have a question for those who have already submitted theirs. The last page, where the eye color chart is... am I to fill that part and submit too and my wife is in Canada as well.. do I also need to fill here?

That's so horrible. What we're the grounds for refusal? Was it based on evidence or misrepresentation because a previous visa refusal does not affect your PR application, just like in my case. The resons for refusal will determine if making a new application will be better than appealing because appealing takes a much longer time. It must feel difficult right now but you just have to persevere. People have come back from the same situation.

However, in the previous application, did you use the use of representative form?
If AVO was aware that it was your representatives fault, it is easier to get through, and be relieved of the blame.
However, if didn't, peruse the refusal notes, get a competent immigration lawyer and appeal.
I am so sorry, it's more painful seeing it is a consequence of someone's mistake.

Most likely the lawyer submitted some altered supporting documents and changed the details in their application.
Some lawyers/agents are from the pit of hell.

Congratulations!!! I pray that i receive mine next week God willing, im February 14th applicant. Yeah i think you should fill the form for both of you.

I am so sorry about your refusal, i think once you get the official letter you should start the appeal process right away, there is still hope and i pray that God see you through in Jesus name. its not over yet, be strong and everything will be alright.

Thanks. Yes, we did 2 visitor visa applications through that lawyer. My husband did not sign any of the paperwork. The second one was done right after the first was refused and I guess he was in a hurry because apparently he didn’t disclose that my husband was previously denied a visa. He did however show us a legal letter he was submitting with the application to explain why he thought the previous denial was unfair. After 6 months of waiting they notified us that this was a problem and gave us a short time to reply, for which the lawyer gathered up the cover letter again and sent in with explanation. However, the visa was still declined and misrepresentation was checked off, but the letter did not clearly indicate that there was any sort of ban. After reading @HisAma

We don’t have the letter yet, but this is what I’m guessing is the issue.

Honestly this form IMM 5669 is causing the most issues. Most of the cases of appeals are surrounding this "misrepresentation" if previously refused. I don't think anyone will intentionally check of No if previously refused. I hope after this year once they realize the main issue with this form at immigration refugee board maybe they can make some changes towards this form that the visa officers atleast have applicants correct their error prior to final decision. No fear sweetie as long as the lawyer made some clerical errors honestly yes you will have the waiting game however appeal within Canada they process it somewhat another waiting game. On average, it takes 4 months from the time your representative submits your Appeal application to the Board until you receive a decision. steps
1.Make sure to first draft a strong letter from the lawyer admitting to his mistake and his clients should not have to pay for is negligence.
2.Ensure you present every detail from previous visa refusal
3.I am not sure you want the same lawyer to represent you due to his errors

Typicaly they do not permit grounds for appeal for misrepresentation however unless the foreign national in question is the sponsor’s spouse, common-law partner or child.

5.8. Loss of appeal rights


A64 specifies the circumstances under which a foreign national, a sponsor or a permanent

resident loses their right of appeal. No appeal may be made to the IAD by a foreign national or

their sponsor or by a permanent resident in respect of a decision that was based on a

determination that the foreign national or permanent resident has been found to be inadmissible

on grounds of security, violating human or international rights, serious criminality or organized

criminality. Serious criminality is further defined in A64(2).

A64(3) also provides for the loss of appeal rights in respect of a decision that was based on a

finding of inadmissibility on the ground of misrepresentation, unless the foreign national in

question is the sponsor’s spouse, common-law partner or child.
