Hey There,

so I have a bit of a complicated question so hopefully you can help.

I sponsored my husband from New York and he got his PR in July of 2016. We did add his daughter who is currently still living in Brooklyn to the application. However now her mother would like to send her here in Canada to live but I know my husbands PR 5 year term must be complete in order for him to apply for her. so my question is would I be able to apply for her? if not would i be able to apply for her as an adoptive parent if her mother fills out and signs the appropriate forms for a step parent legal adoption? Also during this application process could she be in Canada and attend school? if not can you suggest another avenue that i can possibly take that would allow us to bring her to Canada as soon as possible?

The 5 year ban only applies to sponsoring another spouse. Your husband can sponsor his child without issue.

As mentioned, the 5-year sponsorship ban does not apply to this situation.

As long as the daughter is not yet 22 years old, your husband can sponsor her immediately. She will need to do a new medical exam.

While PR app is processing (I've heard can take 6+ months), she can come to Canada as a visitor. You would need to contact schools in your area to ask their policy on students who are only visitors but have a PR app in progress. Policies can differ by individual school, and if they will allow her to attend for free or demand international student fees.
 
okay thanks you! If he does not meet financial obligations would I be able to be a co-sponsor even though my sponsorship period for my husband has not passed? If i am unable to would my mother be able to be a co-sponsor as she has already stated she would be willing to. Also my step daughter is only 9 years old so who would fill out the forms for the person being sponsored on her behalf would it be her mom or my husband?

There is no minimum income requirement to sponsor a child. You can co-sign if you wish.

Anyone can fill out the forms. I believe either legal guardian can sign on her behalf.
 
ok thanks!! this process is so confusing! do you know which forms i would have to fill out for a dependant child only who is a minor because some of the forms state the principal applicant and all dependant children over 18 need to fill out the forms but what if the principal applicant being my step daughter isnt over 18?

Ignore what is stated in the forms and follow the dependent child checklist.
